Il ne peut le faitre que dans trois cas pr\u00e9cis : pour vendre le logement, le reprendre pour lui ou un proche, ou s&rsquo;il existe un motif r\u00e9el et s\u00e9rieux comme des impay\u00e9s de loyers. Cette r\u00e9siliation prend effet \u00e0 la date de renouvellement du bail, et les colocataires doivent \u00eatre pr\u00e9venus au moins 6 mois avant cette date, ou 3 mois dans le cas d&rsquo;un logement meubl\u00e9.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<p>Comme pour la location classique, un <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/bail-colocation\">bail de colocation<\/a> se <strong>renouvelle automatiquement<\/strong> par tacite reconduction, sauf s&rsquo;il s&rsquo;agit d&rsquo;un bail \u00e9tudiant ou d&rsquo;un bail mobilit\u00e9.<\/p>\n\n\n\n<p>Par cons\u00e9quent pour <strong>mettre un terme au bail de colocation<\/strong>, un <strong>propri\u00e9taire doit donner cong\u00e9 au(x) colocataire(s)<\/strong>. Il ne peut le faire que dans des cas pr\u00e9cis :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>s\u2019il souhaite <strong>vendre<\/strong> le logement<\/li>\n\n\n\n<li>s\u2019il souhaite <strong>reprendre<\/strong> le logement pour l\u2019habiter lui-m\u00eame (ou les membres directs de sa famille, ascendants comme descendants)<\/li>\n\n\n\n<li>si un <strong>motif r\u00e9el et s\u00e9rieux<\/strong> justifie de r\u00e9silier le bail (les cas les plus courants \u00e9tant le d\u00e9faut de paiement du loyer et des charges, le non versement du d\u00e9p\u00f4t de garantie alors qu\u2019il \u00e9tait pr\u00e9vu dans le bail, le d\u00e9faut d\u2019assurance alors qu\u2019elle est obligatoire, les troubles anormaux du voisinage)<\/li>\n<\/ul>\n\n\n\n<p>S\u2019il y a un <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/bail-colocation#Bail_individuel\">bail individuel<\/a>, le bailleur doit signifier son cong\u00e9 \u00e0 chaque colocataire titulaire d\u2019un tel bail. Mais s\u2019il y a un <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/bail-colocation#Bail_collectif_ou_bail_a_preneurs_multiples_ou_bail_unique\">bail unique pour tous les colocataires<\/a>, il convient de distinguer 2 cas de figure:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pr\u00e9sence d\u2019une clause de solidarit\u00e9<\/strong> dans le bail :<br>Dans ce cas, le bailleur est en droit d\u2019adresser le cong\u00e9 \u00e0 un seul des colocataires et il vaut pour tous les colocataires puisqu\u2019ils sont li\u00e9s par une <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/clause-solidarite\">clause de solidarit\u00e9<\/a> et qu\u2019ils se repr\u00e9sentent les uns les autres.<br>M\u00eame si le bailleur est en droit de proc\u00e9der ainsi, il reste largement pr\u00e9conis\u00e9 de signifier le cong\u00e9 \u00e0 tous les colocataires.<\/li>\n\n\n\n<li><strong>Absence de clause de solidarit\u00e9<\/strong> dans le bail :<br>Dans ce cas, le bailleur doit adresser son cong\u00e9 \u00e0 chaque colocataire inscrit sur le bail.<\/li>\n<\/ul>\n\n\n\n<p>Lorsque le bailleur souhaite mettre un terme au contrat de colocation pour vendre le logement inoccup\u00e9 (on parle de cong\u00e9 pour vente) ou pour l\u2019habiter lui-m\u00eame (on parle de cong\u00e9 pour reprise), le bailleur ne peut le faire qu\u2019\u00e0 l\u2019\u00e9ch\u00e9ance du bail et en respectant un d\u00e9lai de 6 mois si le logement est lou\u00e9 vide et de 3 mois pour un logement meubl\u00e9.<\/p>\n\n\n\n<p>Le bailleur peut signifier le cong\u00e9 par <strong>lettre recommand\u00e9e avec avis de r\u00e9ception<\/strong> ou par <strong>acte d\u2019huissier<\/strong> ou en <strong>mains propre<\/strong>s (il doit dans ce cas demander un re\u00e7u). Il doit informer le(s) colocataire(s) du motif de la r\u00e9siliation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"prevenir-caution\">Faut-il pr\u00e9venir les garants des colocataires ?<\/h2>\n\n\n\n<p>Lorsque le bailleur souhaite <strong>mettre fin au contrat de colocation<\/strong>, il doit en informer les colocataires, il <strong>n\u2019est pas tenu d\u2019en informer leurs cautions respectives<\/strong>. Il appartient donc aux colocataires de faire conna\u00eetre la date de fin de contrat et donc d\u2019engagement \u00e0 leurs cautions.<\/p>\n\n\n\n<p>Le colocataire titulaire d\u2019un contrat individuel qui donne son cong\u00e9 peut adresser une <strong>copie de sa lettre de cong\u00e9 \u00e0 sa caution<\/strong>. Il n\u2019y a <strong>aucune obligation<\/strong> en la mati\u00e8re mais en pratique c\u2019est important de le faire car la fin du bail signifie la fin de son engagement pour la caution.<\/p>\n\n\n\n<p>Le colocataire qui a sign\u00e9 un bail collectif ou bail unique n\u2019est pas non plus tenu d\u2019informer sa caution de son d\u00e9part de la colocation, mais cela reste <strong>souhaitable<\/strong>. Surtout pour un bail sign\u00e9 apr\u00e8s l\u2019entr\u00e9e en vigueur de la loi ALUR le 27 mars 2014. En effet, la loi ALUR a instaur\u00e9 le principe qu\u2019une caution \u00e9tait solidaire du loyer du colocataire garanti dans les m\u00eames d\u00e9lais que le colocataire.<\/p>\n\n\n\n<p>Rappelons qu\u2019avant l\u2019entr\u00e9e en vigueur de cette loi, la personne qui se portait caution s\u2019engageait pour une dur\u00e9e ferme de 3 ou 6 ans (selon la dur\u00e9e du bail), et qu\u2019elle pouvait \u00eatre sollicit\u00e9e au titre de son engagement m\u00eame si le colocataire qu\u2019il garantissait avait d\u00e9j\u00e0 quitt\u00e9 la colocation. Compte tenu de ces dispositions, informer la caution du d\u00e9part de la colocation ne pr\u00e9sente pas d\u2019int\u00e9r\u00eat particulier puisque l\u2019engagement perdure apr\u00e8s la sortie.
