En cas d\u2019abus, des recours existent pour le locataire.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Au moment de quitter un logement, la <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/entree-logement\/restitution-caution\">restitution du <strong>d\u00e9p\u00f4t de garantie<\/strong><\/a> est souvent une source de tension entre locataire et propri\u00e9taire. Il arrive que certains bailleurs retiennent tout ou partie de cette somme sans raison valable. Dans ce cas, il est possible de <strong>contester une retenue abusive sur le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/entree-logement\/depot-garantie\">d\u00e9p\u00f4t de garantie<\/a><\/strong>. Encore faut-il conna\u00eetre la marche \u00e0 suivre, les d\u00e9lais \u00e0 respecter et les recours \u00e0 envisager. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u26a0\ufe0f Quand peut-on parler de retenue abusive sur le d\u00e9p\u00f4t de garantie ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On parle de <strong>retenue abusive du d\u00e9p\u00f4t de garantie<\/strong> (ou \u00ab\u00a0de la caution\u00a0\u00bb, par abus de langage) quand on se retrouve dans l&rsquo;une ou plusieurs de ces situations :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le bailleur retient une somme <strong>sans justificatif<\/strong> valable,<\/li>\n\n\n\n<li>Le bailleur impute au locataire <strong>des r\u00e9parations qui rel\u00e8vent de l\u2019usure normale<\/strong>,<\/li>\n\n\n\n<li>Le bailleur garde la caution <strong>au-del\u00e0 des d\u00e9lais l\u00e9gaux<\/strong> (1 mois s&rsquo;il n&rsquo;y a pas de d\u00e9g\u00e2ts imput\u00e9s au locataire, 2 mois sinon), sans raison valable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ce type de litige est l&rsquo;un des plus fr\u00e9quents dans la location immobili\u00e8re. Si le locataire y est confront\u00e9, il peut entamer une <strong>contestation de la retenue de la caution<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83e\uddfe Comment contester une retenue abusive sur la caution ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La premi\u00e8re \u00e9tape consiste \u00e0 envoyer une <strong>lettre de contestation du d\u00e9p\u00f4t de garantie<\/strong>, id\u00e9alement par courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception. Cette lettre doit \u00eatre claire, factuelle, et appuy\u00e9e par des pi\u00e8ces justificatives : \u00e9tat des lieux d\u2019entr\u00e9e et de sortie, photos, courriels \u00e9chang\u00e9s, grille de v\u00e9tust\u00e9, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il est essentiel d\u2019y rappeler les <strong>obligations l\u00e9gales du bailleur<\/strong>, notamment le respect du d\u00e9lai d\u2019un mois (ou deux <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/durant-la-location\/litige-bailleur-locataire\">en cas de litige<\/a> av\u00e9r\u00e9). En l\u2019absence de r\u00e9ponse satisfaisante, il est possible de :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Saisir la <strong>commission d\u00e9partementale de conciliation<\/strong> (gratuite et facultative),<\/li>\n\n\n\n<li>Contacter un <strong>conciliateur de justice<\/strong>,<\/li>\n\n\n\n<li>Ou saisir le <strong>juge des contentieux de la protection<\/strong> du tribunal judiciaire.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le juge peut alors ordonner la restitution de la somme retenue \u00e0 tort, voire appliquer <strong>des p\u00e9nalit\u00e9s de retard<\/strong> \u00e9quivalentes \u00e0 <strong>10 % du loyer mensuel par mois de retard<\/strong>, si la retenue est jug\u00e9e infond\u00e9e.<\/p>\n\n\n\n<p class=\"has-border-color has-background wp-block-paragraph\" style=\"border-color:#30a2ce;border-width:1px;background-color:#d2e8ef\">\u2139\ufe0f Le locataire dispose de <strong>3 ans pour agir en justice<\/strong>, d\u00e9lai de prescription en mati\u00e8re locative.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83e\udde0 Bon \u00e0 savoir : ce que le propri\u00e9taire ne peut pas vous imputer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Beaucoup de retenues injustifi\u00e9es concernent des travaux ou remises en \u00e9tat qui ne rel\u00e8vent pas de la responsabilit\u00e9 du locataire. Par exemple, le bailleur ne peut pas vous facturer :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>L\u2019usure normale du logement<\/strong> (peinture l\u00e9g\u00e8rement pass\u00e9e, parquet ray\u00e9 superficiellement\u2026),<\/li>\n\n\n\n<li>Les travaux dus \u00e0 une <strong>malfa\u00e7on<\/strong> ou un <strong>vice de construction<\/strong>,<\/li>\n\n\n\n<li>Les <strong>d\u00e9g\u00e2ts caus\u00e9s par un sinistre<\/strong> non imputable au locataire (comme un d\u00e9g\u00e2t des eaux provenant d\u2019un voisin),<\/li>\n\n\n\n<li>Des <strong>prestations non r\u00e9alis\u00e9es<\/strong> ou des <strong>montants sur\u00e9valu\u00e9s<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pour \u00e9viter toute confusion, il est utile de comparer l\u2019\u00e9tat des lieux d\u2019entr\u00e9e et de sortie point par point. Si une diff\u00e9rence est constat\u00e9e, elle doit \u00eatre explicitement li\u00e9e \u00e0 un manquement du locataire. Par ailleurs rappelons qu&rsquo;en g\u00e9n\u00e9ral, toute retenue doit \u00eatre <strong>proportionnelle <\/strong>au d\u00e9g\u00e2t caus\u00e9 ; un locataire ayant le sentiment que la retenue est clairement disproportionn\u00e9e peut tout \u00e0 fait la contester.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83d\udccc Que faire pour \u00e9viter les litiges au d\u00e9part du logement ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pour limiter les risques de retenue abusive de la caution, il est pr\u00e9f\u00e9rable de bien anticiper son d\u00e9part du logement. Un <strong>nettoyage complet<\/strong>, r\u00e9alis\u00e9 avec soin avant l\u2019\u00e9tat des lieux, permet de montrer que le logement est rendu en bon \u00e9tat. Il est \u00e9galement judicieux de <strong>prendre des photos dat\u00e9es de chaque pi\u00e8ce<\/strong>, ce qui constituera une preuve visuelle utile en cas de d\u00e9saccord. Le jour de l\u2019\u00e9tat des lieux de sortie, il est fortement recommand\u00e9 d\u2019<strong>\u00eatre pr\u00e9sent<\/strong> afin de v\u00e9rifier que les remarques formul\u00e9es sont fond\u00e9es et de s\u2019assurer que le document soit sign\u00e9 par les deux parties. Enfin, <strong>la remise des cl\u00e9s doit se faire en main propre<\/strong> dans la mesure du possible, id\u00e9alement contre r\u00e9c\u00e9piss\u00e9, pour marquer clairement la fin de la location.
