Il est possible de le r\u00e9ajuster \u00e0 l\u2019occasion du renouvellement du bail, sous conditions strictes.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83d\udd75\ufe0f\u200d\u2642\ufe0f <strong>Loyer sous-\u00e9valu\u00e9 : attention au fisc<\/strong> !<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Proposer un loyer trop bas \u00e0 son locataire peut para\u00eetre g\u00e9n\u00e9reux ou strat\u00e9gique, mais cela peut se retourner contre le bailleur. En effet, un <strong>loyer sous-\u00e9valu\u00e9<\/strong> peut \u00e9veiller les soup\u00e7ons de l\u2019administration fiscale, surtout en cas de location \u00e0 un proche (dans ce cas, il vaut mieux pr\u00eater son logement gratuitement, sans aucun loyer).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le fisc peut requalifier ce type de location comme un <strong>avantage en nature<\/strong>, notamment si le bien est lou\u00e9 <strong>significativement en dessous des prix du march\u00e9 local<\/strong>. Cela peut avoir des cons\u00e9quences :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Une rectification fiscale<\/strong>, notamment en mati\u00e8re d\u2019imp\u00f4t sur le revenu ou d\u2019IFI (imp\u00f4t sur la fortune immobili\u00e8re),<\/li>\n\n\n\n<li>Une remise en cause d\u2019\u00e9ventuels <strong>avantages fiscaux<\/strong>, comme ceux li\u00e9s \u00e0 un dispositif de d\u00e9fiscalisation,<\/li>\n\n\n\n<li>Et dans les cas les plus sensibles, <strong>une taxation sur les revenus fictifs<\/strong> correspondant \u00e0 la diff\u00e9rence de loyer.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pour \u00e9viter cela, il est essentiel de <strong>justifier le montant du loyer<\/strong> pratiqu\u00e9, m\u00eame lorsqu\u2019on loue \u00e0 un membre de sa famille. En cas de contr\u00f4le, le propri\u00e9taire doit pouvoir prouver que le loyer n\u2019est <strong>pas manifestement sous-\u00e9valu\u00e9<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83d\udcc8 <strong>Quand et comment augmenter un loyer sous-\u00e9valu\u00e9 ?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En dehors de l\u2019<a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/revision-loyer\">augmentation annuelle pr\u00e9vue dans le bail<\/a> (en fonction de l\u2019IRL), le propri\u00e9taire peut r\u00e9ajuster un <strong>loyer sous-\u00e9valu\u00e9<\/strong> uniquement <strong>lors du renouvellement du bail<\/strong>. Cette proc\u00e9dure est strictement encadr\u00e9e par <strong>l\u2019article 17-2 de la <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/loi-location\/loi-6-juillet-1989\">loi du 6 juillet 1989<\/a><\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour \u00eatre valable, cette d\u00e9marche doit respecter plusieurs conditions :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le bailleur doit envoyer au locataire <strong>au moins 6 mois avant la fin du bail<\/strong> une <strong>lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception<\/strong> l\u2019informant du <strong>nouveau loyer propos\u00e9<\/strong>.<\/li>\n\n\n\n<li>Cette lettre doit <strong>mentionner clairement les r\u00e9f\u00e9rences<\/strong> de <strong>logements comparables<\/strong>, situ\u00e9s dans le m\u00eame secteur g\u00e9ographique. Il faut :\n<ul class=\"wp-block-list\">\n<li><strong>3 r\u00e9f\u00e9rences minimum<\/strong> pour les villes ordinaires,<\/li>\n\n\n\n<li><strong>6 r\u00e9f\u00e9rences<\/strong> si le logement est situ\u00e9 dans une <strong>agglom\u00e9ration de plus d\u2019un million d\u2019habitants<\/strong> (comme Paris, Lyon, Marseille&#8230;).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Elle doit <strong>reproduire int\u00e9gralement le texte de l\u2019article 17-2<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udcdd <strong>Important<\/strong> : Le d\u00e9lai de 6 mois commence \u00e0 courir <strong>\u00e0 partir de la r\u00e9ception<\/strong> du courrier par le locataire, et non de sa date d\u2019envoi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2696\ufe0f <strong>Et si le locataire refuse l\u2019augmentation ?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le locataire est libre d\u2019accepter ou non la proposition de hausse. En cas de <strong>d\u00e9saccord<\/strong>, le bailleur peut saisir la <strong>commission d\u00e9partementale de conciliation<\/strong>, qui tentera de trouver un terrain d\u2019entente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si aucun accord n\u2019est trouv\u00e9, le juge peut \u00eatre saisi pour trancher. Le loyer ne sera r\u00e9vis\u00e9 <strong>qu\u2019\u00e0 condition que la proc\u00e9dure ait \u00e9t\u00e9 correctement engag\u00e9e dans les d\u00e9lais<\/strong>. \u00c0 d\u00e9faut, la r\u00e9\u00e9valuation ne pourra pas s\u2019appliquer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2757 <strong>Attention aux cas particuliers<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis le <strong>24 ao\u00fbt 2022<\/strong>, il est <strong>interdit d\u2019augmenter le loyer<\/strong> d\u2019un logement class\u00e9 <strong>F ou G<\/strong> au <strong>DPE<\/strong> (<a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/dpe-location\">diagnostic de performance \u00e9nerg\u00e9tique<\/a>). Cela s\u2019applique aussi bien aux <strong>nouveaux contrats<\/strong> qu\u2019aux <strong>renouvellements<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De plus, dans les villes soumises \u00e0 <strong>l\u2019<a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/encadrement-loyers-alur\">encadrement des loyers<\/a><\/strong>, le nouveau montant propos\u00e9 <strong>ne peut pas d\u00e9passer le loyer de r\u00e9f\u00e9rence major\u00e9<\/strong>, sauf cas exceptionnels (confort particulier, localisation, etc.).<\/p>\n<div style='text-align:left' class='yasr-auto-insert-visitor'><\/div>","protected":false},"excerpt":{"rendered":"<p>Un loyer manifestement sous-\u00e9valu\u00e9 peut \u00eatre source de probl\u00e8mes, notamment avec le fisc.
