Parmi les principales pr\u00e9occupations, les <strong>loyers impay\u00e9s<\/strong> arrivent en t\u00eate. Pourtant, peu de propri\u00e9taires connaissent le <strong>bail notari\u00e9<\/strong>, une solution simple mais redoutablement efficace. On vous explique pourquoi cette formule m\u00e9rite d\u2019\u00eatre envisag\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83e\uddfe Qu\u2019est-ce qu\u2019un bail notari\u00e9\u202f?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le bail notari\u00e9 est un <strong>acte authentique<\/strong> \u00e9tabli par un notaire. Contrairement au <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/bail\">bail<\/a> \u00ab classique \u00bb sign\u00e9 entre particuliers (dit sous seing priv\u00e9), celui-ci est sign\u00e9 <strong>devant un notaire<\/strong> et conserve une <strong>valeur juridique renforc\u00e9e<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette signature authentique donne au contrat plusieurs propri\u00e9t\u00e9s pr\u00e9cieuses\u202f:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Une <strong>date de prise d&rsquo;effet certaine<\/strong>, incontestable en cas de litige,<\/li>\n\n\n\n<li>Une <strong>force probante \u00e9lev\u00e9e<\/strong> (le contenu du bail est difficilement contestable),<\/li>\n\n\n\n<li>Et surtout, le statut de <strong>titre ex\u00e9cutoire<\/strong>, un avantage majeur pour le bailleur pour <strong>effectuer des saisies aupr\u00e8s du locataire<\/strong> sans passer un tribunal.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">En clair, c\u2019est un bail en b\u00e9ton, r\u00e9dig\u00e9 par un professionnel du droit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2705 Pourquoi choisir un bail notari\u00e9 quand on est propri\u00e9taire<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">La possibilit\u00e9 d&rsquo;effectuer des saisies sur salaire sans passer par un juge<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">C\u2019est l\u2019avantage num\u00e9ro un. En cas de <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/impayes-loyers\/impayes-loyers-que-faire\">loyer impay\u00e9<\/a>, le bailleur peut transmettre la <strong>copie ex\u00e9cutoire<\/strong> du contrat directement \u00e0 un commissaire de justice, sans passer par un tribunal. Cela permet de d\u00e9clencher imm\u00e9diatement des mesures de recouvrement\u202f: saisie sur salaire, saisie bancaire ou sur du mobilier. <strong>Le gain de temps est consid\u00e9rable<\/strong>, et le stress r\u00e9duit d\u2019autant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u26a0\ufe0f Attention, cela ne fonctionne que si le bail contient une clause ex\u00e9cutoire, ou \u00ab\u00a0clause d\u2019ex\u00e9cution forc\u00e9e\u00a0\u00bb (qui est en r\u00e9alit\u00e9 plus une formulation qu&rsquo;une clause \u00e0 proprement parler). Voici un exemple-type de r\u00e9daction : <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u00ab\u00a0Le locataire reconna\u00eet devoir au bailleur les loyers et charges convenus, et s\u2019engage \u00e0 les r\u00e9gler aux \u00e9ch\u00e9ances pr\u00e9vues. Le pr\u00e9sent acte est rev\u00eatu de la formule ex\u00e9cutoire conform\u00e9ment \u00e0 l\u2019article L.111-3 du Code des proc\u00e9dures civiles d\u2019ex\u00e9cution. En cons\u00e9quence, il peut faire l\u2019objet d\u2019une ex\u00e9cution forc\u00e9e en cas de manquement aux obligations qu\u2019il constate.\u00a0\u00bb<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Un contrat conforme, r\u00e9dig\u00e9 dans les r\u00e8gles<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Le notaire s\u2019assure que le contrat <strong>respecte toutes les exigences l\u00e9gales\u202f<\/strong>: diagnostics obligatoires, annexes, mentions encadrant les loyers, etc. Il v\u00e9rifie l&rsquo;identit\u00e9 du locataire et du bailleur, si le logement appartient bien au propri\u00e9taire, et la conformit\u00e9 des pi\u00e8ces fournies. R\u00e9sultat\u202f: un contrat sans clauses abusives ni oublis, et donc beaucoup moins de risques de litiges.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Une s\u00e9curit\u00e9 juridique renforc\u00e9e<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Gr\u00e2ce \u00e0 sa nature d\u2019acte authentique, le bail notari\u00e9 b\u00e9n\u00e9ficie d\u2019une <strong>force probante sup\u00e9rieure<\/strong>. Son contenu est donc difficilement contestable, sauf via une proc\u00e9dure en faux, ce qui est tr\u00e8s rare. Il poss\u00e8de \u00e9galement une <strong>date certaine<\/strong>, reconnue de fa\u00e7on incontestable. Ce point peut \u00eatre pr\u00e9cieux pour prouver une dur\u00e9e d\u2019occupation, une date d\u2019effet ou faire valoir certains droits aupr\u00e8s d\u2019organismes (comme la CAF).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u26a0\ufe0f Ce qu\u2019il faut savoir avant de choisir un bail notari\u00e9<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le principal inconv\u00e9nient, c\u2019est son <strong>co\u00fbt<\/strong>. En moyenne, il faut compter <strong>un demi-mois de loyer hors charges<\/strong>, r\u00e9parti \u00e0 parts \u00e9gales entre le bailleur et le locataire. Pour un loyer de 800\u202f\u20ac, cela repr\u00e9sente environ 400\u202f\u20ac pour chaque partie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il faut aussi un peu d\u2019organisation. La signature n\u00e9cessite un rendez-vous chez le notaire, la pr\u00e9sence des deux parties (ou de leurs mandataires), et un court d\u00e9lai pour que le contrat soit pr\u00e9par\u00e9. M\u00eame s&rsquo;il offre une protection accrue pour le bailleur, <strong>le bail notari\u00e9 n\u2019autorise pas une <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/resiliation-bail-proprietaire\/expulsion-locataire\">expulsion<\/a> directe<\/strong>\u202f: seul un juge peut l\u2019ordonner. Ce contrat facilite le recouvrement des sommes dues, mais ne remplace pas la proc\u00e9dure judiciaire pour reprendre un logement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83e\udde9 Quand le bail notari\u00e9 est-il particuli\u00e8rement recommand\u00e9\u202f?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le bail notari\u00e9 est une solution id\u00e9ale dans plusieurs cas\u202f:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si vous louez un bien pour une <strong>dur\u00e9e longue<\/strong> (r\u00e9sidence principale, usage professionnel ou mixte) ;<\/li>\n\n\n\n<li>Si vous <strong>g\u00e9rez vous-m\u00eame<\/strong> vos biens, sans agence, et souhaitez vous pr\u00e9munir contre les erreurs ;<\/li>\n\n\n\n<li>Si vous avez connu <strong>des probl\u00e8mes d\u2019impay\u00e9s<\/strong> ou si le dossier du locataire vous semble fragile ;<\/li>\n\n\n\n<li>Si vous louez via une <strong>SCI<\/strong>, ou dans un cadre de gestion patrimoniale plus structur\u00e9 ;<\/li>\n\n\n\n<li>Ou encore si vous proposez une <strong>colocation<\/strong> avec plusieurs signataires (cas souvent litigieux).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Dans toutes ces situations, ce type de contrat permet de partir sur des bases solides.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\ud83d\udd0e Comment mettre en place un bail notari\u00e9<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La d\u00e9marche est simple. Il suffit de <strong>contacter un notaire<\/strong> en amont de la signature. Celui-ci vous demandera les documents n\u00e9cessaires : titre de propri\u00e9t\u00e9, pi\u00e8ce d\u2019identit\u00e9, informations sur le locataire, diagnostics, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Une fois le contrat r\u00e9dig\u00e9, les deux parties signent l\u2019acte en sa pr\u00e9sence.
