Dans ce cas, le bailleur peut effectuer une retenue, qui doit \u00eatre justifi\u00e9e par un devis ou une facture. Cette retenue peut \u00eatre contest\u00e9e par le locataire si celui-ci l&rsquo;estime abusive.<\/p>\n\n\n\n<div class=\"txtcenter\">\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Quelle diff\u00e9rence entre \u00ab\u00a0r\u00e9cup\u00e9rer la caution\u00a0\u00bb et \u00ab\u00a0r\u00e9cup\u00e9rer le d\u00e9p\u00f4t de garantie\u00a0\u00bb ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aucune ! M\u00eame si le terme correct est \u00ab\u00a0d\u00e9p\u00f4t de garantie\u00a0\u00bb, on parle souvent, par abus de langage, de \u00ab\u00a0r\u00e9cup\u00e9rer la caution d&rsquo;un appartement\u00a0\u00bb. Dans ce contexte (celui de la somme d&rsquo;argent vers\u00e9e au bailleur en guise de garantie), les deux termes sont \u00e9quivalents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00e9lais de restitution du d\u00e9p\u00f4t de garantie<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Avec la loi Alur, la restitution totale du <a href=\"\/guides\/guide-locataire\/entree-logement\/depot-garantie\">d\u00e9p\u00f4t de garantie<\/a> doit se faire dans un d\u00e9lai maximal d&rsquo;<strong>un mois<\/strong> \u00e0 compter de la remise des cl\u00e9s si l&rsquo;\u00e9tat des lieux de sortie de fait pas appara\u00eetre de d\u00e9gradations par rapport \u00e0 l&rsquo;\u00e9tat des lieux d&rsquo;entr\u00e9e. S&rsquo;il y a des diff\u00e9rences entre l&rsquo;\u00e9tat des lieux d&rsquo;entr\u00e9e et l&rsquo;\u00e9tat des lieux de sortie, le propri\u00e9taire a <strong>deux mois<\/strong> pour restituer la somme au locataire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si le propri\u00e9taire tarde \u00e0 rendre le d\u00e9p\u00f4t de garantie, le locataire peut lui exp\u00e9dier une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception pour lui r\u00e9clamer le remboursement. Si cette d\u00e9marche reste infructueuse, pour <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/durant-la-location\/litige-bailleur-locataire\">r\u00e9gler le litige<\/a>, le locataire peut :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>saisir la Commission D\u00e9partementale de Conciliation s&rsquo;il souhaite tenter de r\u00e9gler le litige \u00e0 l&rsquo;amiable ;<\/li>\n\n\n\n<li>ou bien intenter une proc\u00e9dure d&rsquo;injonction de payer devant le tribunal judiciaire.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/loi-location\/loi-alur\">loi Alur<\/a> pr\u00e9voit des <strong>p\u00e9nalit\u00e9s de retard<\/strong> : le d\u00e9p\u00f4t de garantie d\u00fb est major\u00e9 d&rsquo;un montant \u00e9gal \u00e0 10% du loyer hors charges pour chaque mois de retard entam\u00e9. La jurisprudence indique que cette disposition s&rsquo;applique \u00e0 <strong>tous les contrats de location, m\u00eame ceux sign\u00e9s avant la loi Alur<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dans quels cas le propri\u00e9taire peut faire une retenue sur le d\u00e9p\u00f4t de garantie ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le propri\u00e9taire peut faire une <strong>retenue<\/strong> partielle ou totale sur le montant du d\u00e9p\u00f4t de garantie&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si le rapprochement des \u00e9tats des lieux d&rsquo;entr\u00e9e et de sortie fait appara\u00eetre des d\u00e9t\u00e9riorations imputables au locataire, sauf si celles-ci ont \u00e9t\u00e9 occasionn\u00e9es par v\u00e9tust\u00e9, malfa\u00e7on ou vice de construction.<\/li>\n\n\n\n<li>S&rsquo;il existe des loyers et charges impay\u00e9s.<\/li>\n\n\n\n<li>Si la taxe sur les ordures m\u00e9nag\u00e8res n&rsquo;a pas \u00e9t\u00e9 pay\u00e9e, elle peut \u00eatre d\u00e9duite au prorata du temps d&rsquo;occupation du locataire.<\/li>\n\n\n\n<li>Si le bien lou\u00e9 est en copropri\u00e9t\u00e9, le propri\u00e9taire peut conserver une partie du d\u00e9p\u00f4t de garantie (20 % maximum) jusqu&rsquo;\u00e0 ce qu&rsquo;il re\u00e7oive le d\u00e9compte des charges annuelles ; dans ce cas il n&rsquo;est pas soumis aux p\u00e9nalit\u00e9s de retard vues plus haut.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">En cas de d\u00e9gradations importantes, si le d\u00e9p\u00f4t de garantie est insuffisant, le propri\u00e9taire a le droit de <strong>demander un compl\u00e9ment<\/strong> au locataire.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"681\" src=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/11\/restitution-caution-1.png\" alt=\"Restitution du d\u00e9p\u00f4t de garantie\" class=\"wp-image-2036\" style=\"box-shadow:none;aspect-ratio:1.3333333333333333;object-fit:cover;width:520px;height:auto\" srcset=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/11\/restitution-caution-1.png 800w, https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/11\/restitution-caution-1-300x255.png 300w, https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/11\/restitution-caution-1-768x654.png 768w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Les retenues sur la caution doivent \u00eatre justifi\u00e9es<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Les sommes que le propri\u00e9taire r\u00e9clame au locataire doivent \u00eatre <strong>justifi\u00e9es <\/strong>et<strong> correspondre \u00e0 ce qui est mentionn\u00e9 dans l&rsquo;\u00e9tat des lieux de sortie <\/strong>pour ne pas \u00eatre consid\u00e9r\u00e9es comme abusives. Il ne peut pas fixer arbitrairement le montant des r\u00e9parations mais doit pr\u00e9senter des <strong>devis <\/strong>ou <strong>factures <\/strong>de professionnels.<\/p>\n\n\n\n<p class=\"has-border-color has-background wp-block-paragraph\" style=\"border-color:#ffec49;border-width:1px;background-color:#fffcbc\">&nbsp;Toute la difficult\u00e9, lors du calcul de la retenue sur la caution, est de diff\u00e9rencier ce qui est <strong>imputable au locataire<\/strong>, de ce qui rel\u00e8ve de l&rsquo;<strong>usure normale du temps<\/strong> (qui est \u00e0 la charge du bailleur). C&rsquo;est pour cela que l&rsquo;<a href=\"\/guides\/guide-locataire\/entree-logement\/etat-des-lieux\">\u00e9tat des lieux<\/a> de sortie devrait dans l&rsquo;id\u00e9al se baser sur une <strong>grille de v\u00e9tust\u00e9<\/strong> dont un mod\u00e8le est t\u00e9l\u00e9chargeable <a href=\"https:\/\/www.locservice.fr\/actualites\/wp-content\/uploads\/2016\/04\/grille_de_vetuste.pdf\">ici<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lorsque le propri\u00e9taire effectue lui-m\u00eame les travaux de remise en \u00e9tat dans sa location, il ne peut pas facturer de main d&rsquo;\u0153uvre \u00e0 son locataire, seul le prix d&rsquo;achat des mat\u00e9riaux sera d\u00e9duit du d\u00e9p\u00f4t de garantie (\u00e0 condition bien s\u00fbr de conserver les factures). Le bailleur n&rsquo;est pas oblig\u00e9 de produire les justificatifs dans le d\u00e9lai de deux mois pr\u00e9vu pour la restitution du d\u00e9p\u00f4t de garantie, cependant il doit respecter un d\u00e9lai raisonnable pour les faire parvenir au locataire.<br><br>Le remboursement du d\u00e9p\u00f4t de garantie est un des sujets de contentieux les plus fr\u00e9quents dans les rapports locatifs&nbsp;: la justification des co\u00fbts et leurs pertinences sont difficiles \u00e0 d\u00e9terminer. Cependant, lorsque le d\u00e9p\u00f4t de garantie a \u00e9t\u00e9 rendu au locataire, il arr\u00eate d\u00e9finitivement les comptes et implique une <strong>renonciation \u00e0 toute r\u00e9clamation ult\u00e9rieure<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-group has-border-color has-background is-layout-constrained wp-block-group-is-layout-constrained\" style=\"border-color:#cccccc;border-width:1px;background-color:#eeeeee\">\n<h2 class=\"wp-block-heading\">FAQ &#8211; Questions fr\u00e9quentes sur la restitution de la caution<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Quel est le d\u00e9lai l\u00e9gal de restitution de la caution ?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Le bailleur dispose d\u2019un d\u00e9lai de 1 mois apr\u00e8s la remise des cl\u00e9s<\/strong> si l\u2019\u00e9tat des lieux de sortie est conforme \u00e0 celui d\u2019entr\u00e9e. Ce d\u00e9lai passe \u00e0 <strong>2 mois<\/strong> en cas de d\u00e9gradations ou de r\u00e9serves mentionn\u00e9es dans l\u2019\u00e9tat des lieux de sortie.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Peut-on faire une retenue sur le d\u00e9p\u00f4t de garantie sans \u00e9tat des lieux de sortie ?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Sans \u00e9tat des lieux de sortie contradictoire, <strong>le logement est pr\u00e9sum\u00e9 rendu en bon \u00e9tat<\/strong>. Le bailleur ne peut donc <strong>pas effectuer de retenues<\/strong>, sauf preuve contraire.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Que faire en cas de non-restitution de la caution dans les d\u00e9lais ?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Vous pouvez d\u2019abord <strong>envoyer une lettre de relance<\/strong>, puis une <strong>mise en demeure<\/strong>. En l\u2019absence de r\u00e9ponse, vous pouvez <strong>saisir le juge des contentieux de la protection<\/strong>. Le bailleur peut \u00eatre condamn\u00e9 \u00e0 verser des <strong>p\u00e9nalit\u00e9s de retard de 10 % du montant par mois de retard<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le propri\u00e9taire peut-il d\u00e9duire des frais du d\u00e9p\u00f4t de garantie ?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Oui, mais <strong>uniquement si les montants sont justifi\u00e9s<\/strong> par des d\u00e9gradations anormales, avec <strong>factures ou devis \u00e0 l\u2019appui<\/strong>, ET si cela est marqu\u00e9 dans l&rsquo;\u00e9tat des lieux de sortie.
