La loi pr\u00e9voit des dispositions concernant l&rsquo;\u00e9tat des lieux d&rsquo;entr\u00e9e, mais <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/durant-la-location\/litige-bailleur-locataire\">les litiges<\/a> apparaissent surtout lors de l&rsquo;\u00e9tat des lieux de sortie ; dans ce cas, l&rsquo;intervention d&rsquo;un huissier ou de la commission de conciliation est n\u00e9cessaire.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Faire un ajout \u00e0 l&rsquo;\u00e9tat des lieux d&rsquo;entr\u00e9e<\/h2>\n\n\n\n<p>M\u00eame si l&rsquo;<a href=\"\/guides\/guide-locataire\/entree-logement\/etat-des-lieux\">\u00e9tat des lieux<\/a> d&rsquo;entr\u00e9e a \u00e9t\u00e9 fait avec soin, il peut arriver que le locataire d\u00e9couvre, <strong>apr\u00e8s son installation<\/strong>, un <strong>d\u00e9faut<\/strong>, une d\u00e9gradation ou un vice de construction <strong>qui n&rsquo;a pas \u00e9t\u00e9 not\u00e9<\/strong> dans le document. Dans ce cas la loi lui laisse un <strong>d\u00e9lai de 10 jours<\/strong> \u00e0 compter de son installation pour demander au bailleur de <strong>faire un compl\u00e9ment d&rsquo;\u00e9tat des lieux<\/strong>, de pr\u00e9f\u00e9rence par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception. Si le bailleur refuse, le locataire peut saisir la <a href=\"https:\/\/www.locservice.fr\/actualites\/savoir-commission-de-conciliation-solution-amiable-litiges-locatifs-4548.html\">commission d\u00e9partementale de conciliation<\/a>.<\/p>\n\n\n\n<p>Un autre cas de figure concerne les \u00e9quipements de <strong>chauffage <\/strong>: ceux-ci ne sont pas n\u00e9cessairement test\u00e9s pendant l&rsquo;\u00e9tat des lieux d&rsquo;entr\u00e9e, soit par manque de temps soit en raison d&rsquo;une absence d&rsquo;\u00e9lectricit\u00e9. Par cons\u00e9quent la loi pr\u00e9voit que si le locataire se rend compte d&rsquo;un d\u00e9faut concernant ces \u00e9quipements de chauffage <strong>pendant le premier mois de chauffe<\/strong>, il peut \u00e9galement demander au bailleur d<strong>&lsquo;ajouter<\/strong> ce d\u00e9faut dans l&rsquo;\u00e9tat des lieux.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00c9tat des lieux de sortie non sign\u00e9 : que faire ?<\/h2>\n\n\n\n<p>L&rsquo;\u00e9tat des lieux de sortie peut faire l&rsquo;objet de litiges, notamment en ce qui concerne qui doit payer quoi. Ainsi, il n&rsquo;est pas rare qu&rsquo;un <strong>locataire refuse de signer l&rsquo;\u00e9tat des lieux de sortie<\/strong> pour manifester son d\u00e9saccord. Etant donn\u00e9 que le document d&rsquo;\u00e9tat des lieux doit imp\u00e9rativement \u00eatre <strong>sign\u00e9 par les deux parties<\/strong>, l&rsquo;absence d&rsquo;une signature le rend <strong>non valable <\/strong>et<strong> emp\u00eache tout retenue sur le d\u00e9p\u00f4t de garantie<\/strong>. Dans ce cas, et si toute d\u00e9marche amiable est vaine, seule l&rsquo;intervention d&rsquo;un <strong>huissier <\/strong>peut d\u00e9bloquer la situation. En effet, un huissier a le pouvoir de dresser un \u00e9tat des lieux qui sera valable m\u00eame en l&rsquo;absence du locataire ou du bailleur.<\/p>\n\n\n\n<p>Cela est aussi valable, bien s\u00fbr, en cas de d\u00e9saccord sur un \u00e9tat des lieux d&rsquo;entr\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Contester un \u00e9tat des lieux de sortie sign\u00e9<\/h2>\n\n\n\n<p>Une fois que l&rsquo;\u00e9tat des lieux de sortie est sign\u00e9 par les deux parties, il devient tr\u00e8s difficile de le contester car la signature marque l&rsquo;approbation. Le propri\u00e9taire peut tout de m\u00eame tenter <strong>revenir sur l\u2019\u00e9tat des lieux<\/strong>, mais c\u2019est \u00e0 condition de produire les preuves suffisantes que les d\u00e9g\u00e2ts concern\u00e9s sont bien imputables au locataire sortant.
