Cette mesure impose que les loyers demand\u00e9s dans une ville ne soient ni sup\u00e9rieurs ni inf\u00e9rieurs \u00e0 une fourchette de prix. Cette derni\u00e8re est \u00e9tablie par arr\u00eat\u00e9 pr\u00e9fectoral \u00e0 partir d&rsquo;un loyer m\u00e9dian de r\u00e9f\u00e9rence. L&rsquo;encadrement des loyers est cens\u00e9 prendre fin en novembre 2026.<\/p>\n\n\n\n<p>L&rsquo;encadrement des loyers tel qu&rsquo;instaur\u00e9 par la loi Elan est en quelque sorte un <strong>plafonnement des loyers<\/strong>. Il ne faut pas confondre cette mesure avec le d\u00e9cret d&rsquo;<a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/encadrement-loyers-relocation\">encadrement des loyers \u00e0 la relocation<\/a>, qui, lui, a pour but de limiter les hausses de loyer lors des renouvellements de bail ou des changements de locataires dans les zones tendues. Les deux mesures peuvent cependant se <strong>cumuler<\/strong>.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Historique de l&rsquo;encadrement des loyers<\/h2>\n\n\n\n<p>L&rsquo;encadrement des loyers a \u00e9t\u00e9 initialement cr\u00e9\u00e9 par la <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/loi-location\/loi-alur\">loi ALUR du 27 mars 2014<\/a> pour r\u00e9guler les loyers dans les agglom\u00e9rations dont le march\u00e9 locatif est tendu. Sa mise en application d\u00e9pendait de la pr\u00e9sence d&rsquo;un observatoire des loyers local capable de fournir des donn\u00e9es suffisamment repr\u00e9sentatives, et de la publication d&rsquo;un arr\u00eat\u00e9 pr\u00e9fectoral fixant les loyers de r\u00e9f\u00e9rence fournis par l&rsquo;observatoire. En vigueur pendant un temps \u00e0 Paris et \u00e0 Lille, il a \u00e9t\u00e9 invalid\u00e9 dans ces deux villes par d\u00e9cision de justice fin 2017 suite \u00e0 une faille l\u00e9gale dans son mode d&rsquo;application.<\/p>\n\n\n\n<p>La <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/loi-location\/loi-elan\">loi Elan<\/a> de novembre 2018, via l&rsquo;article 140, donne la possibilit\u00e9 aux agglom\u00e9rations volontaires, \u00e0 la commune de Paris, et aux m\u00e9tropoles de Lyon et d&rsquo;Aix-Marseille de r\u00e9tablir l&rsquo;encadrement des loyers \u00e0 titre exp\u00e9rimental sur une p\u00e9riode de 5 ans, p\u00e9riode qui a ensuite \u00e9t\u00e9 <a href=\"https:\/\/www.locservice.fr\/actualites\/lencadrement-des-loyers-prolonge-de-3-ans-avec-un-pouvoir-de-sanction-accru-9011.html\">\u00e9tendue \u00e0 8 ans avec la loi \u00ab\u00a03DS\u00a0\u00bb<\/a>. Les modalit\u00e9s d&rsquo;application sont sensiblement les m\u00eames qu&rsquo;avec la loi Alur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zones\">Listes des villes o\u00f9 l&rsquo;encadrement des loyers est en vigueur<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Encadrement des loyers \u00e0 <strong>Paris <\/strong>: pour les baux sign\u00e9s \u00e0 compter du 1er juillet 2019.<\/li>\n\n\n\n<li>Encadrement des loyers \u00e0 <strong>Lille<\/strong>, <strong>Lomme <\/strong>et <strong>Hellemmes <\/strong>: pour les baux sign\u00e9s \u00e0 compter du 1er mars 2020.<\/li>\n\n\n\n<li>Encadrement des loyers sur l&rsquo;<strong>intercommunalit\u00e9&nbsp;Plaine Commune<\/strong> (93) : Aubervilliers, La Courneuve, \u00c9pinay-sur-Seine, L\u2019\u00cele-Saint-Denis, Pierrefitte-sur-Seine, Saint-Denis, Saint-Ouen, Stains et Villetaneuse, et ce pour les baux sign\u00e9s \u00e0 compter du 1er juin 2021.<\/li>\n\n\n\n<li>Encadrement des loyers sur l&rsquo;<strong>intercommunalit\u00e9 Est Ensemble<\/strong> (93) : Bagnolet, Bobigny, Bondy, Le Pr\u00e9-Saint-Gervais, Les Lilas, Montreuil, Noisy-le-Sec, Pantin et Romainville , et ce pour les baux sign\u00e9s \u00e0 compter du 1er d\u00e9cembre 2021.<\/li>\n\n\n\n<li>Encadrement des loyers \u00e0 <strong>Lyon <\/strong>et <strong>Villeurbanne <\/strong>:&nbsp;pour les baux sign\u00e9s \u00e0 compter du 1er novembre 2021.<\/li>\n\n\n\n<li>Encadrement des loyers \u00e0 <strong>Montpellier <\/strong>: pour les baux sign\u00e9s \u00e0 compter du 1er juillet 2022.<\/li>\n\n\n\n<li>Encadrement des loyers \u00e0 <strong>Bordeaux <\/strong>: pour les baux sign\u00e9s \u00e0 compter du 15 juillet 2022.<\/li>\n\n\n\n<li>Encadrement des loyers dans le <strong>pays Basque <\/strong>: pour les baux sign\u00e9s \u00e0 compter du 25 novembre 2024 (<a href=\"https:\/\/www.locservice.fr\/actualites\/encadrement-loyers-pays-basque-12816.html\">voir la liste des communes concern\u00e9es au pays Basque<\/a>).<\/li>\n\n\n\n<li>Encadrement des loyers \u00e0 <strong>Grenoble <\/strong>et sa p\u00e9riph\u00e9rie : pour les baux sign\u00e9s \u00e0 compter du 20 janvier 2025 (liste des communes concern\u00e9es (<a href=\"https:\/\/www.locservice.fr\/actualites\/encadrement-loyers-grenoble-13435.html\">voir la liste des communes de Grenoble et sa p\u00e9riph\u00e9rie<\/a>).<\/li>\n<\/ul>\n\n\n\n<p class=\"has-border-color has-background\" style=\"border-color:#30a2ce;border-width:1px;background-color:#d2e8ef\">\u2139\ufe0f <strong>Pour conna\u00eetre les loyers de r\u00e9f\u00e9rence<\/strong> des diff\u00e9rentes villes \u00e0 l&rsquo;aide de simulateurs, rendez-vous sur <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F1314\">cette page du Service Public<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le fonctionnement de l&rsquo;encadrement des loyers<\/h2>\n\n\n\n<p>L&rsquo;indicateur pour l\u2019encadrement des loyers est le <strong>loyer m\u00e9dian<\/strong>, il permet d\u2019\u00eatre plus stable et moins sensible aux extr\u00eames. Il y a diff\u00e9rents loyers m\u00e9dians selon le nombre de pi\u00e8ces principales, le caract\u00e8re meubl\u00e9\/non meubl\u00e9, l&rsquo;ann\u00e9e de construction, et bien s\u00fbr la zone g\u00e9ographique. Ce sont ces loyers m\u00e9dians qui servent de loyers de r\u00e9f\u00e9rence.<\/p>\n\n\n\n<p class=\"has-text-align-center has-border-color has-background has-medium-font-size\" style=\"border-color:#ffec49;border-width:1px;background-color:#fffcbc\">\ud83d\udc49 Pour respecter l&rsquo;encadrement des loyers, le loyer demand\u00e9 (hors charges) doit \u00eatre compris entre le <strong>loyer de r\u00e9f\u00e9rence major\u00e9 de 20 %<\/strong> et le <strong>loyer de r\u00e9f\u00e9rence minor\u00e9 de 30 %<\/strong>.<\/p>\n\n\n\n<p>Cela concerne les <strong><a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/proprietaire-louer-mon-appartement\">premi\u00e8res mises en location<\/a><\/strong>, les <strong>changements de locataires<\/strong> et les <strong>renouvellements de bail<\/strong>.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"700\" height=\"394\" src=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/12\/encadrement-des-loyers-mini.png\" alt=\"\" class=\"wp-image-1489\" srcset=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/12\/encadrement-des-loyers-mini.png 700w, https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/12\/encadrement-des-loyers-mini-300x169.png 300w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Quels logements sont concern\u00e9s par l&rsquo;encadrement ?<\/h2>\n\n\n\n<p>L&rsquo;encadrement des loyers ne concerne que les <strong>logements du parc priv\u00e9<\/strong>, <strong>vides<\/strong> ou <strong>meubl\u00e9s<\/strong>, d\u00e8s lors qu&rsquo;ils servent de <strong>r\u00e9sidence principale<\/strong>. Il ne s&rsquo;applique pas pour les logements HLM, les logements conventionn\u00e9s APL (y compris les logements conventionn\u00e9s Anah), les logements soumis \u00e0 la loi de 1948 et les locations saisonni\u00e8res.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le compl\u00e9ment de loyer pour les biens d&rsquo;exception<\/h2>\n\n\n\n<p>La mesure d&rsquo;encadrement des loyers permet de demander un <strong>compl\u00e9ment de loyer<\/strong> au locataire si le logement (meubl\u00e9 ou non meubl\u00e9) poss\u00e8de des caract\u00e9ristiques de localisation ou de confort le justifiant, par comparaison avec les logements de la m\u00eame cat\u00e9gorie situ\u00e9s dans le m\u00eame secteur g\u00e9ographique.<\/p>\n\n\n\n<p>Si les parties conviennent d\u2019un tel compl\u00e9ment, son montant et les caract\u00e9ristiques sur lesquelles il se base doivent \u00eatre mentionn\u00e9s au <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/bail\">contrat de bail<\/a>. A noter que les pr\u00e9fets et les EPCI ont \u00e9galement le pouvoir d&rsquo;infliger des sanctions aux bailleurs contrevenants.<\/p>\n\n\n\n<p><strong><u>Action du bailleur pour augmenter un loyer sous-\u00e9valu\u00e9<\/u><\/strong><br>Si le loyer est inf\u00e9rieur au loyer de r\u00e9f\u00e9rence minor\u00e9, le bailleur peut proposer un nouveau loyer au locataire au moins 6 mois avant la date de renouvellement du bail.<\/p>\n\n\n\n<p>En cas de <strong>d\u00e9saccord<\/strong>, l&rsquo;une ou l&rsquo;autre des parties peut saisir la commission d\u00e9partementale de conciliation.
