C&rsquo;est le bailleur qui s&rsquo;acquitte de r\u00e9gler ces charges, mais il en r\u00e9cup\u00e8re le montant aupr\u00e8s du locataire via une somme qui vient s&rsquo;additionner au loyer. Il peut proc\u00e9der \u00e0 une r\u00e9gularisation annuelle en cas de trop-per\u00e7u ou de moins-per\u00e7u.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Charges forfaitaires ou provisions pour charges ?<\/h2>\n\n\n\n<p>Pour r\u00e9cup\u00e9rer les charges aupr\u00e8s du locataire, le propri\u00e9taire a le choix entre deux solutions :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>une provision pour charges<\/strong>, aussi appel\u00e9e <strong>avance sur charges<\/strong> : il s&rsquo;agit de r\u00e9cup\u00e9rer le montant r\u00e9el des charges aupr\u00e8s du locataire en lui demandant une avance chaque mois et en proc\u00e9dant \u00e0 une r\u00e9gularisation chaque ann\u00e9e lorsque le r\u00e9sultat des comptes est connu. Cette m\u00e9thode a l&rsquo;avantage d&rsquo;\u00eatre plus \u00e9quitable, mais elle est relativement complexe a mettre en oeuvre. C&rsquo;est la plus courante pour les locations vides.<\/li>\n\n\n\n<li>une <strong>somme forfaitaire<\/strong>, c&rsquo;est-\u00e0-dire fix\u00e9e contractuellement d&rsquo;apr\u00e8s une estimation de la somme r\u00e9elle et\/ou d&rsquo;apr\u00e8s ce que payait l&rsquo;ancien locataire. Celle-ci ne peut donner droit \u00e0 aucune r\u00e9gularisation. C&rsquo;est une solution beaucoup plus simple, mais \u00ab\u00a0risqu\u00e9e\u00a0\u00bb pour le propri\u00e9taire qui ne peut rien r\u00e9clamer si les charges \u00e0 payer r\u00e9ellement d\u00e9passent les sommes r\u00e9cup\u00e9r\u00e9es aupr\u00e8s du locataire. Ce type de solution est tr\u00e8s fr\u00e9quent en location meubl\u00e9e, dont les baux sont g\u00e9n\u00e9ralement plus courts qu&rsquo;en location vide.<\/li>\n<\/ul>\n\n\n\n<p>Dans tous les cas, le paiement des charges r\u00e9cup\u00e9rables dans les d\u00e9lais impartis constitue une <strong>obligation <\/strong>pour le locataire, au m\u00eame titre que le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/fixer-loyer\">loyer de base<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"liste-charges-recuperables\">Liste des charges r\u00e9cup\u00e9rables<\/h2>\n\n\n\n<p>Trois types de charges font l&rsquo;objet de provisions&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les frais entra\u00een\u00e9s par les services li\u00e9s au logement (eau, ascenseur ou un chauffage collectif).<\/li>\n\n\n\n<li>Les d\u00e9penses d&rsquo;entretien et de petites r\u00e9parations des parties communes de l&rsquo;immeuble (sauf si les frais sont dus \u00e0 des erreurs ou des malfa\u00e7ons de l&rsquo;immeuble).<\/li>\n\n\n\n<li>Les services dont b\u00e9n\u00e9ficient le locataire tel l&rsquo;enl\u00e8vement des ordures m\u00e9nag\u00e8res ou l&rsquo;assainissement.<\/li>\n<\/ul>\n\n\n\n<p>La liste des charges locatives est pr\u00e9cis\u00e9e par le <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGITEXT000006066149\/\">d\u00e9cret n\u00b087-713 du 26 ao\u00fbt 1987<\/a>. Elle est limitative : les charges qui n&rsquo;y sont pas mentionn\u00e9es ne peuvent pas \u00eatre factur\u00e9es au locataire. Elle comprend&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les taxes locatives&nbsp;: taxe de balayage et ordures m\u00e9nag\u00e8res.<\/li>\n\n\n\n<li>Les produits consommables&nbsp;: eau, \u00e9lectricit\u00e9, produit d&rsquo;entretien et d&rsquo;hygi\u00e8ne, ampoules&#8230;<\/li>\n\n\n\n<li>Les d\u00e9penses d&rsquo;entretien et les menues r\u00e9parations des parties communes (la maintenace de l&rsquo;ascenceur est partag\u00e9e entre le propri\u00e9taire et le locataire).<\/li>\n\n\n\n<li>Les salaires du concierge (maxi 75%) s&rsquo;il effectue le nettoyage des parties communes et la gestion des poubelles.<\/li>\n<\/ul>\n\n\n\n<p>De plus, le locataire doit r\u00e9parer tout ce qu&rsquo;il d\u00e9t\u00e9riore, prendre \u00e0 sa charge l&rsquo;entretien courant des \u00e9quipements&nbsp;(voir notre guide sur <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/travaux-location\/travaux-locataire\">les travaux et r\u00e9parations \u00e0 la charge du locataire<\/a>) :<br><strong>Ext\u00e9rieurs&nbsp;:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Jardin privatif&nbsp;: entretien des pelouses, massifs, taille des arbustes.<\/li>\n\n\n\n<li>Terrasse&nbsp;: enlever la mousse, d\u00e9gorger les conduits.<\/li>\n\n\n\n<li>Ouvertures&nbsp;: graisser les gonds, remplacer les boutons de poign\u00e9es, r\u00e9fection des mastics, remplacement des vitres cass\u00e9es.<\/li>\n<\/ul>\n\n\n\n<p><strong>Int\u00e9rieurs&nbsp;:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Maintien en \u00e9tat de propret\u00e9 des murs int\u00e9rieurs et cloisons, raccords de peintures, encaustiquer ou vitrifier les parquets, remplacer les moquettes en cas de taches et de trous.<\/li>\n\n\n\n<li>Entretien courant pour les canalisations d&rsquo;eau et de gaz, vidange de fosses septiques, la chaudi\u00e8re, les appareils sanitaires et l&rsquo;\u00e9lectrom\u00e9nager (D\u00e9cret 87-712 du 26 ao\u00fbt 1987).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"liste-charges-non-recuperables\">Liste des charges non r\u00e9cup\u00e9rables<\/h2>\n\n\n\n<p>Le bailleur doit assumer (voir notre guide sur <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/travaux-location\/travaux-proprietaire\">les travaux et r\u00e9parations \u00e0 la charge du propri\u00e9taire<\/a>) :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les d\u00e9gradations occasionn\u00e9es par la v\u00e9tust\u00e9 du logement ou des \u00e9quipements, des vices de construction, de malfa\u00e7on ou encore des \u00e9ventuels cas de force majeure, par exemple les intemp\u00e9ries.<\/li>\n\n\n\n<li>les charges qui valorisent l&rsquo;immeuble ou le bien.<\/li>\n\n\n\n<li>le remplacement des tuiles ou ardoises, les goutti\u00e8res, les chemin\u00e9es, balcons, terrasses, volets, portes, installation \u00e9lectrique d\u00e9fectueuse, \u00e9quipements m\u00e9nager hors d&rsquo;usage.<\/li>\n<\/ul>\n\n\n\n<p>Certains travaux sont des obligations administratives (d\u00e9cret du 9 septembre 2004)&nbsp;: raccordement \u00e0 l&rsquo;\u00e9gout, enfouissement de lignes t\u00e9l\u00e9phoniques ou \u00e9lectriques, ravalement, mises au normes d&rsquo;ascenseur, porte coupe feu, etc.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"regularisation-charges\">La r\u00e9gularisation des charges<\/h2>\n\n\n\n<p>Une <strong>r\u00e9gularisation<\/strong> doit \u00eatre effectu\u00e9e <strong>chaque ann\u00e9e<\/strong> pour ajuster les versements du locataire aux d\u00e9penses r\u00e9elles. <strong>Si le propri\u00e9taire oublie de r\u00e9gulariser<\/strong> les charges et qu&rsquo;il en fait la demande au-del\u00e0 de la fin de l&rsquo;ann\u00e9e civile suivant l&rsquo;ann\u00e9e de r\u00e9gularisation (par exemple au del\u00e0 du 31 d\u00e9cembre 2019 pour la r\u00e9gularisation de l&rsquo;ann\u00e9e 2018), le locataire est en droit de <strong>demander un \u00e9talement de la dette<\/strong> sur 12 mois (<a href=\"https:\/\/www.locservice.fr\/_media\/etalement-dettes-charges-locatives.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">voir notre mod\u00e8le de lettre<\/a>). Le propri\u00e9taire a un <strong>d\u00e9lai de prescription<\/strong> de <strong>3 ans<\/strong> pour r\u00e9gulariser les charges impay\u00e9es (la prescription \u00e9tait 5 ans avant la loi Alur).<br>Le d\u00e9compte des charges doit \u00eatre adress\u00e9 au locataire un mois avant la r\u00e9gularisation annuelle. Il doit pr\u00e9ciser les cat\u00e9gories de d\u00e9penses auxquelles les charges correspondent ainsi que la mani\u00e8re dont elles sont r\u00e9parties entre les locataires.<br>Dans les immeubles en copropri\u00e9t\u00e9, le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/copropriete\/syndic-copropriete\">syndic<\/a> doit fournir aux copropri\u00e9taires qui louent leur logement, les justificatifs permettant l&rsquo;\u00e9tablissement du d\u00e9compte des <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/copropriete\/charges-copropriete\">charges de copropri\u00e9t\u00e9<\/a>.<br>Les pi\u00e8ces justificatives des charges (factures) doivent \u00eatre tenues \u00e0 la disposition du locataire pendant six mois apr\u00e8s l&rsquo;envoi du
