La GRL n&rsquo;est plus distibu\u00e9e depuis le 1er janvier 2016, et les locataires doivent d\u00e9sormais se tourner vers le dispositif <strong><a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/entree-logement\/visale\">Visale<\/a><\/strong>.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">L&rsquo;\u00e9volution de la GRL<\/h2>\n\n\n\n<p>La Garantie des Risques Locatifs a \u00e9t\u00e9 initialement cr\u00e9\u00e9e par l&rsquo;Etat et les partenaires sociaux du 1 % logement (devenu depuis <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/aides-logement\/aides-action-logement\">Action Logement<\/a>), afin de faciliter l&rsquo;accession \u00e0 la location des personnes en situation pr\u00e9caire.<\/p>\n\n\n\n<p>Pour cela, l&rsquo;Etat venait se porter garant du paiement des loyers aupr\u00e8s propri\u00e9taires. L&rsquo;ancienne version de la GRL couvrait exclusivement les risques d&rsquo;impay\u00e9s et les d\u00e9t\u00e9riorations immobili\u00e8res. Cependant, un bailleur ne pouvait souscrire \u00e0 cette garantie que si son futur locataire remplissait certaines conditions, attest\u00e9es par un document indispensable : le Passeport Pass-GRL. Par contre, si le locataire \u00e9tait d\u00e9j\u00e0 en place depuis plus de 6 mois, il \u00e9tait dispens\u00e9 du Passeport Pass-GRL mais devait satisfaire d&rsquo;autres exigences.<\/p>\n\n\n\n<p>Devant toutes ces contraintes, de nombreux bailleurs ont pr\u00e9f\u00e9r\u00e9 souscrire une assurance Garantie Loyers Impay\u00e9s \u00ab\u00a0classique\u00a0\u00bb aupr\u00e8s de leur assureur. Le dispositif n&rsquo;a pas rencontr\u00e9 le succ\u00e8s escompt\u00e9 et une nouvelle version de la GRL a \u00e9t\u00e9 mise en chantier.<\/p>\n\n\n\n<p>Cette derni\u00e8re a finalement \u00e9t\u00e9 <a href=\"https:\/\/www.locservice.fr\/actualites\/sylvia-pinel-presente-officiellement-le-dispositif-visale-3081.html\" target=\"_blank\" rel=\"noreferrer noopener\">remplac\u00e9e par la garantie Visale d\u00e9but janvier 2016<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">L&rsquo;objectif de la nouvelle GRL<\/h2>\n\n\n\n<p>Mise en place le 1er Janvier 2010, l&rsquo;objectif de la nouvelle GRL \u00e9tait de favoriser l&rsquo;acc\u00e8s \u00e0 la location. Selon les mots de Benoist Apparu, alors Secr\u00e9taire d&rsquo;Etat au Logement, ce nouveau dispositif devait \u00ab convaincre les propri\u00e9taires de 650 000 logements vacants de remettre leurs biens sur le march\u00e9 de la location, et am\u00e9liorer le traitement social de l&rsquo;impay\u00e9 en s&rsquo;int\u00e9ressant aux locataires insolvables d\u00e8s les premiers incidents de paiement&nbsp;\u00bb.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les conditions de la GRL<\/h2>\n\n\n\n<p>Ce contrat d&rsquo;assurance \u00e9tait propos\u00e9 uniquement par les assureurs priv\u00e9s, en rapport direct avec L&rsquo;Etat et Action Logement.<\/p>\n\n\n\n<p>Le \u00ab contrat socle \u00bb qui r\u00e9gissait la nouvelle GRL \u00e9tait constitu\u00e9 de 3 garanties minimales (chaque assureur pouvait y ajouter ses propres options suppl\u00e9mentaires) :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>&nbsp;La couverture des impay\u00e9s de loyers jusqu&rsquo;\u00e0 70&nbsp;000&nbsp;\u20ac (pour un loyer maximum de 2&nbsp;000&nbsp;\u20ac charges comprises)<\/li>\n\n\n\n<li>Des frais de contentieux pris en charge (avocat, huissier &#8230;)<\/li>\n\n\n\n<li>Les d\u00e9gradations locatives couvertes \u00e0 hauteur de 7&nbsp;700&nbsp;\u20ac pour une location nue et 3&nbsp;500&nbsp;\u20ac pour<\/li>\n<\/ul>\n\n\n\n<p>La GRL s&rsquo;appliquait si les 2 conditions suivantes \u00e9taient remplies :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le logement devait \u00eatre lou\u00e9 (nu ou meubl\u00e9) en tant que r\u00e9sidence principale, avec un loyer inf\u00e9rieur \u00e0 2 000 \u20ac mensuels (charges comprises)<\/li>\n\n\n\n<li>Le taux d&rsquo;effort du locataire \u00e9tait inf\u00e9rieur ou \u00e9gal \u00e0 50 % (le taux d&rsquo;effort correspond au loyer + charges divis\u00e9 par les revenus mensuels).
