Autrement dit, c&rsquo;est une mani\u00e8re l\u00e9gale de d\u00e9roger <strong>temporairement <\/strong>au bail classique lorsque celui-ci est inadapt\u00e9 \u00e0 la situation.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">La convention d&rsquo;occupation pr\u00e9caire : d\u00e9finition<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La convention d\u2019occupation pr\u00e9caire est un contrat \u201c<strong>sui generis<\/strong>\u201d, c&rsquo;est-\u00e0-dire issu de la jurisprudence. Il s\u2019agit d\u2019un contrat entre deux parties : un bailleur et un preneur. Le bailleur accorde un <strong>droit exceptionnel d\u2019occupation<\/strong> \u00e0 un preneur sur un de ses biens en contrepartie d\u2019une somme financi\u00e8re <strong>modique<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La convention d\u2019occupation pr\u00e9caire permet de <strong>d\u00e9roger au droit des baux d&rsquo;habitation ou commerciaux<\/strong> en accordant un droit de jouissance \u00e0 un occupant pour un logement ou local donn\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conditions de validit\u00e9 de la convention d&rsquo;occupation pr\u00e9caire<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aucun texte ne r\u00e9git ce type de convention et c\u2019est pourquoi la jurisprudence admet sa validit\u00e9 <strong>uniquement si certaines conditions sont remplies<\/strong>. Il faut en effet que le droit de l&rsquo;occupant soit pr\u00e9caire, ce qui implique une contrepartie particuli\u00e8rement faible. Il faut \u00e9galement qu\u2019il existe des circonstances particuli\u00e8res ind\u00e9pendantes de la volont\u00e9 des parties pour justifier de la mise en place d\u2019une telle convention.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">La cause objective de pr\u00e9carit\u00e9<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Le propri\u00e9taire doit tout d\u2019abord pouvoir justifier d\u2019une <strong>cause objective de pr\u00e9carit\u00e9<\/strong> pour d\u00e9roger au droit locatif.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concr\u00e8tement, la conclusion de ce type de contrat doit \u00eatre motiv\u00e9e par des <strong>circonstances exceptionnelles emp\u00eachant les parties de conclure un v\u00e9ritable bail<\/strong>. Et il doit \u00e9galement exister un lien entre la dur\u00e9e de l&rsquo;occupation et les circonstances invoqu\u00e9es.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ces circonstances exceptionnelles peuvent ainsi \u00eatre li\u00e9es :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>au caract\u00e8re discontinu et temporaire de l&rsquo;occupation ;<\/li>\n\n\n\n<li>\u00e0 la situation transitoire de l&rsquo;immeuble ;<\/li>\n\n\n\n<li>\u00e0 la situation g\u00e9ographique du local ;<\/li>\n\n\n\n<li>\u00e0 la mise \u00e0 disposition temporaire dans le cadre de l&rsquo;op\u00e9ration de relogement des familles sans abri ;<\/li>\n\n\n\n<li>au fait que l&rsquo;occupation des lieux se fasse sous condition d&rsquo;acquisition du bien.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Par exemple, le fait que l\u2019immeuble soit vou\u00e9 \u00e0 la d\u00e9molition est retenu comme une cause objective de pr\u00e9carit\u00e9. De m\u00eame, ce type de contrat a \u00e9t\u00e9 accept\u00e9 lors des <strong>confinements <\/strong>li\u00e9s \u00e0 la crise sanitaire afin de permettre \u00e0 des locataires arrivant au terme de leur pr\u00e9avis d\u2019\u00eatre maintenus dans leur logement.<\/p>\n\n\n\n<p class=\"has-border-color has-background wp-block-paragraph\" style=\"border-color:#ffec49;border-width:1px;background-color:#fffcbc\">&nbsp;\u26a0\ufe0f Attention : si aucune cause de pr\u00e9carit\u00e9 ne peut \u00eatre retenue, la convention pourra \u00eatre requalifi\u00e9e en <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/bail\">bail<\/a> par un juge en cas de litige.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">La modicit\u00e9 de la redevance<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La convention d\u2019occupation pr\u00e9caire est conclue entre un bailleur et un \u201coccupant \u00e0 titre pr\u00e9caire\u201d. On parle donc de redevance et non de loyer. En contrepartie de la pr\u00e9carit\u00e9 d\u2019occupation des locaux, la redevance doit respecter 3 caract\u00e9ristiques :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00catre \u00e0 titre on\u00e9reux ;<\/li>\n\n\n\n<li>\u00catre modique ;<\/li>\n\n\n\n<li>Ne pas engendrer de charges locatives pour l\u2019occupant.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9gime juridique<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le r\u00e9gime juridique de la convention d&rsquo;occupation pr\u00e9caire est celui des <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=1D56BF51CC28D57BECF106713EC9CFA8.tplgfr23s_2?idSectionTA=LEGISCTA000006136386&amp;cidTexte=LEGITEXT000006070721&amp;dateTexte=20200429\">articles 1709 et suivants du Code civil<\/a>. L\u2019occupant ne peut donc pas b\u00e9n\u00e9ficier des m\u00eames droits que ceux qu\u2019il aurait dans le cadre d\u2019un bail commercial ou d\u2019habitation :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019occupant ne peut pr\u00e9tendre \u00e0 une indemnit\u00e9 d\u2019\u00e9viction de la part du bailleur ;<\/li>\n\n\n\n<li>L\u2019occupant ne peut pr\u00e9tendre \u00e0 un droit au renouvellement de la convention ;<\/li>\n\n\n\n<li>L\u2019occupant doit quitter les locaux ou le logement d\u00e8s l\u2019expiration de la convention ou sa d\u00e9nonciation.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Sauf disposition contractuelle contraire, le propri\u00e9taire peut en effet <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/resiliation-bail-proprietaire\/locataire-refuse-quitter-logement\">mettre fin \u00e0 l\u2019occupation du bien<\/a> \u00e0 tout moment en mettant en demeure l\u2019occupant de quitter les lieux<strong> sans que ce dernier ne puisse se pr\u00e9valoir d\u2019un droit au maintien<\/strong> dans les locaux.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le bailleur doit en revanche durant la dur\u00e9e de la convention assurer la <strong>jouissance paisible <\/strong>des lieux lou\u00e9s, cette obligation ne cessant qu&rsquo;en cas de force majeure.<br>&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-uagb-info-box uagb-block-6dd64dee uagb-infobox__content-wrap  uagb-infobox-icon-above-title uagb-infobox-image-valign-top\"><div class=\"uagb-ifb-content\"><div class=\"uagb-ifb-image-content\"><img decoding=\"async\" src=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/11\/guide_eg-1.png\" alt=\"\" width=\"160\" height=\"105\" loading=\"lazy\"\/><\/div><div class=\"uagb-ifb-title-wrap\"><h3 class=\"uagb-ifb-title\">Propri\u00e9taires-bailleurs, besoin de vous faire accompagner pour votre activit\u00e9 de location ?<\/h3><\/div><p class=\"uagb-ifb-desc\"> <strong>Diagnostics, travaux, aide \u00e0 la gestion locative<\/strong>&#8230;
