Il permet une r\u00e9duction d&rsquo;imp\u00f4ts jusqu&rsquo;\u00e0 21 % du montant de l&rsquo;investissement, en \u00e9change d&rsquo;une obligation de louer son bien \u00e0 des locataires dont les revenus ne d\u00e9passent pas un certain plafond, et pour un loyer lui aussi mod\u00e9r\u00e9. Elle a \u00e9t\u00e9 arr\u00eat\u00e9e le\u00a0<strong>31 d\u00e9cembre 2024.<\/strong><\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Historique<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le dispositif dit \u00ab\u00a0<strong>Pinel<\/strong>\u00a0\u00bb est en r\u00e9alit\u00e9 une \u00e9volution du dispositif&nbsp;<strong>Duflot&nbsp;<\/strong>(du nom de la ministre du logement de l&rsquo;\u00e9poque) entr\u00e9 en vigueur le 1er janvier 2013 en remplacement du <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/loi-scellier\">Scellier<\/a>. Il a \u00e9t\u00e9 rebaptis\u00e9 \u00ab\u00a0Pinel\u00a0\u00bb en septembre 2014 \u00e0 l&rsquo;occasion des quelques modifications qu&rsquo;il a re\u00e7ues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le&nbsp;<strong>dispositif Pinel<\/strong>&nbsp;vise donc les op\u00e9rations r\u00e9alis\u00e9es entre le&nbsp;<strong>1er septembre 2014 et le 31 d\u00e9cembre 2024&nbsp;<\/strong>(pr\u00e9vu initialement pour fin 2021). Pour les op\u00e9rations r\u00e9alis\u00e9es du 1er janvier 2013 au 31 ao\u00fbt 2014, c&rsquo;est le dispositif Duflot qui s&rsquo;applique. Les principales diff\u00e9rences du Pinel par rapport au Duflot concernent le&nbsp;<strong>choix de la dur\u00e9e d&rsquo;engagement<\/strong> (qui fait varier le taux de r\u00e9duction) et la&nbsp;<strong>possibilit\u00e9 de louer aux ascendants ou aux descendants<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">En quoi consiste l&rsquo;avantage fiscal du dispositif Pinel<\/h2>\n\n\n\n<div class=\"wp-block-media-text has-media-on-the-right is-stacked-on-mobile\" style=\"grid-template-columns:auto 38%\"><div class=\"wp-block-media-text__content\">\n<p class=\"wp-block-paragraph\">La d\u00e9fiscalisation en loi Pinel permet de d\u00e9duire de ses imp\u00f4ts une partie du prix du logement, qui d\u00e9pend de la dur\u00e9e pendant laquelle on s&rsquo;engage \u00e0 le louer :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>12 %<\/strong>&nbsp;pour une p\u00e9riode de 6 ans,<\/li>\n\n\n\n<li><strong>18 %<\/strong>&nbsp;pour une p\u00e9riode de 9 ans<\/li>\n\n\n\n<li><strong>21 %<\/strong>&nbsp;pour une p\u00e9riode de 12 ans<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pour les investissements r\u00e9alis\u00e9s avant le 1er septembre 2014 (donc \u00e0 l&rsquo;\u00e9poque du \u00ab\u00a0Duflot\u00a0\u00bb), il y avait un taux unique : 18 %, pour une p\u00e9riode de 9 ans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le montant investi en dispositif Pinel est doublement plafonn\u00e9 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>limite de 300.000 \u20ac d&rsquo;investissement par an,<\/li>\n\n\n\n<li>limite de 5.500 \u20ac\/m\u00b2 de la surface habitable<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Par exemple, pour un appartement de 40m\u00b2 \u00e0 250.000 \u20ac, la r\u00e9duction d&rsquo;imp\u00f4t sera calcul\u00e9e sur 40 x 5500 = 220.000 \u20ac<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elle peut s&rsquo;appliquer \u00e0 un&nbsp;<strong>maximum de 2 investissements par an<\/strong>.<\/p>\n<\/div><figure class=\"wp-block-media-text__media\"><img loading=\"lazy\" decoding=\"async\" width=\"470\" height=\"353\" src=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/12\/201903061115088364.jpg\" alt=\"\" class=\"wp-image-738 size-full\" srcset=\"https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/12\/201903061115088364.jpg 470w, https:\/\/www.locservice.fr\/guides\/wp-content\/uploads\/2024\/12\/201903061115088364-300x225.jpg 300w\" sizes=\"auto, (max-width: 470px) 100vw, 470px\" \/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Les obligations du dispositif Pinel<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le logement doit se trouver dans des zones g\u00e9ographiques caract\u00e9ris\u00e9es par un d\u00e9ficit d&rsquo;offres, c&rsquo;est-\u00e0-dire les zones&nbsp;<strong>A, A bis, et B1<\/strong>. Dans les villes des zones B2 et C qui b\u00e9n\u00e9ficiaient d&rsquo;un arr\u00eat\u00e9 pr\u00e9fectoral autorisant le Pinel, le dispositif n&rsquo;est plus applicable \u00e0 partir du 1er janvier 2018. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour permettre une sortie progressive de ces communes, la loi de finances pour 2018 maintient la d\u00e9fiscalisation pour les logements dont le permis de construire a \u00e9t\u00e9 d\u00e9pos\u00e9 avant le 1er janvier 2018 et si l&rsquo;acte authentique de vente devant notaire est sign\u00e9 avant le 1er janvier 2019.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi Pinel ne concerne que les logements&nbsp;<strong>neufs, en cours de construction, anciens r\u00e9nov\u00e9s ou r\u00e9habilit\u00e9s, ou bien des locaux transform\u00e9s en habitations<\/strong>. L&rsquo;engagement de location est de&nbsp;<strong>6 ans minimum<\/strong>. Le propri\u00e9taire dispose d&rsquo;1 an maximum pour commencer \u00e0 louer, \u00e0 compter de l&rsquo;ach\u00e8vement du bien ou de son acquisition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le logement doit r\u00e9pondre aux normes r\u00e9centes de&nbsp;<strong>performance \u00e9nerg\u00e9tique<\/strong>. Pour les logements neufs : labels BBC ou RT 2012. Pour les anciens : labels r\u00e9novation 2009 ou BBC r\u00e9novation 2009. Cela permet d&rsquo;\u00e9viter les <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/aides-renovation-energetique\/passoires-thermiques\">passoires thermiques<\/a> aux locataires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le logement doit \u00eatre <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/bail\/bail-location-vide\">lou\u00e9 vide<\/a> et il doit constituer la r\u00e9sidence principale du locataire. Le locataire ne peut pas \u00eatre un membre du foyer fiscal du propri\u00e9taire. Depuis le 1er janvier 2015, il peut cependant \u00eatre un ascendant ou un descendant du propri\u00e9taire. Cette zone B2 n&rsquo;est \u00e9ligible que sous d\u00e9rogation temporaire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A noter qu&rsquo;il existe <strong>dispositif d\u00e9rogatoire au droit commun<\/strong> pour la Bretagne : le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/pinel-breton\">Pinel breton<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les plafonds de loyer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Les loyers doivent \u00eatre&nbsp;<strong>inf\u00e9rieurs de 20 % au prix du march\u00e9<\/strong>.
