{"id":774,"date":"2024-12-23T12:18:05","date_gmt":"2024-12-23T11:18:05","guid":{"rendered":"https:\/\/www.locservice.fr\/guides\/?p=774"},"modified":"2026-01-02T11:11:37","modified_gmt":"2026-01-02T10:11:37","slug":"loc-avantages","status":"publish","type":"post","link":"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/loc-avantages","title":{"rendered":"Dispositif Loc&rsquo;Avantages"},"content":{"rendered":"\n<p class=\"a-retenir\"><strong>Loc&rsquo;Avantages<\/strong> est le nom de la nouvelle version du dispositif <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/louer-abordable\">Louer Abordable<\/a>, en vigueur \u00e0 compter du <strong>1er mars 2022<\/strong>. Tout comme ce dernier, il s&rsquo;agit d&rsquo;un dispositif de d\u00e9fiscalisation bas\u00e9 sur un engagement de louer son logement moins cher que les prix du march\u00e9. En contrepartie, le propri\u00e9taire b\u00e9n\u00e9ficie d&rsquo;une <strong>r\u00e9duction d&rsquo;imp\u00f4t<\/strong> sur ses revenus locatifs qui peut aller jusqu&rsquo;\u00e0 65 %. Plus le loyer est r\u00e9duit, plus la r\u00e9duction d\u2019imp\u00f4t est \u00e9lev\u00e9e. Le dispositif Loc&rsquo;Avantages est <strong>programm\u00e9 jusqu&rsquo;au 31&nbsp;d\u00e9cembre&nbsp;2027<\/strong>.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Comment b\u00e9n\u00e9ficier du dispositif Loc&rsquo;Avantages ?<\/h2>\n\n\n\n<p>Les conditions pour \u00eatre \u00e9ligible \u00e0 ce dispositif sont les suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le logement doit \u00eatre nu (non meubl\u00e9) ;<\/li>\n\n\n\n<li>Le logement doit servir d&rsquo;habitation principale au locataire ;<\/li>\n\n\n\n<li>Le logement ne doit pas \u00eatre class\u00e9 F ou G dans son <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/dpe-location\">DPE<\/a> ;<\/li>\n\n\n\n<li>Le logement ne peut \u00eatre lou\u00e9 \u00e0 un membre de la famille du propri\u00e9taire ;<\/li>\n\n\n\n<li>Le locataire doit avoir des revenus inf\u00e9rieurs \u00e0 des plafonds de ressources fix\u00e9s par l\u2019\u00c9tat.<\/li>\n<\/ul>\n\n\n\n<p>Pour b\u00e9n\u00e9ficier du dispositif, le propri\u00e9taire doit <strong>signer une convention avec l&rsquo;Anah<\/strong> (Agence nationale de l&rsquo;habitat) dans laquelle il doit choisir entre trois niveaux de loyer, qui sont calcul\u00e9s en appliquant une d\u00e9cote au loyer de march\u00e9 observ\u00e9 sur la commune du logement (ou son arrondissement pour Paris, Lyon et Marseille). Les trois niveaux possibles de d\u00e9cote sont les suivants :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Niveau \u00ab\u00a0Loc 1\u00a0\u00bb : &#8211; 15 %<\/li>\n\n\n\n<li>Niveau \u00ab\u00a0Loc 2\u00a0\u00bb : &#8211; 30 %<\/li>\n\n\n\n<li>Niveau \u00ab\u00a0Loc 3\u00a0\u00bb : &#8211; 45 % (disponible uniquement en interm\u00e9diation locative)<\/li>\n<\/ul>\n\n\n\n<p>Le choix du niveau de d\u00e9cote d\u00e9terminera quel est le <strong>loyer maximal<\/strong> qu&rsquo;il pourra appliquer, quels seront les <strong>plafonds de ressources<\/strong> du locataire \u00e0 respecter, et quel sera le niveau de r\u00e9duction d&rsquo;imp\u00f4t. <strong>L&rsquo;engagement de louer est au minimum de 6 ans<\/strong>. Pour conna\u00eetre les plafonds de ressources et de loyers, rendez-vous sur <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/R61610\" target=\"_blank\" rel=\"noreferrer noopener\">le simulateur de l&rsquo;Anah<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter\"><a href=\"https:\/\/www.locservice.fr\/proprietaires\/\"><img decoding=\"async\" src=\"https:\/\/locservicev2.s3.eu-west-3.amazonaws.com\/guide\/cta-ls-prop.jpg\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Quelle sera la r\u00e9duction d&rsquo;imp\u00f4t possible ?<\/h2>\n\n\n\n<p>Il faut noter qu&rsquo;\u00e0 la diff\u00e9rence du dispositif Louer Abordable qui \u00e9tait bas\u00e9 sur une d\u00e9duction d&rsquo;imp\u00f4ts, Loc&rsquo;Avantages est une <strong>r\u00e9duction d&rsquo;imp\u00f4ts<\/strong>. Le m\u00e9canisme de r\u00e9duction d\u2019imp\u00f4t permet d\u2019uniformiser le montant de l\u2019avantage fiscal, quel que soit le taux marginal d\u2019imposition du propri\u00e9taire.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter\"><img decoding=\"async\" src=\"https:\/\/locservicev2.s3.eu-west-3.amazonaws.com\/guide\/202202221643430905.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p>Selon le gouvernement, \u00a0\u00bb Les taux retenus permettent d\u2019assurer aux propri\u00e9taires bailleurs une rentabilit\u00e9 sup\u00e9rieure \u00e0 celle sans Loc\u2019Avantages\u00a0\u00bb.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les avantages de l&rsquo;interm\u00e9diation locative<\/h2>\n\n\n\n<p>L&rsquo;interm\u00e9diation locative est le fait de confier un logement \u00e0 un organisme tiers qui s&rsquo;occupe de faire l&rsquo;interm\u00e9diaire entre le propri\u00e9taire et le locataire. Cet organisme peut <strong>soit avoir un mandat de gestion<\/strong> similaire \u00e0 une agence immobili\u00e8re classique, <strong>soit fonctionner en louant lui-m\u00eame le logement<\/strong> puis en le sous-louant ensuite \u00e0 un locataire (ce qui garantit des revenus stables au propri\u00e9taire). L&rsquo;interm\u00e9diation locative est ainsi utilis\u00e9e pour aider des <strong>profils pr\u00e9caires<\/strong> \u00e0 se loger.<\/p>\n\n\n\n<p>Avec Loc\u2019Avantages, lors d\u2019une location en interm\u00e9diation locative, le taux de r\u00e9duction d\u2019imp\u00f4t est augment\u00e9 de 5 points par rapport \u00e0 celui applicable en location directe (pour les niveaux Loc1 et Loc2 ). La r\u00e9duction d\u2019imp\u00f4t est particuli\u00e8rement avantageuse lorsque les loyers pratiqu\u00e9s sont au niveau Loc3, qui n&rsquo;est accessible que dans le cadre de l\u2019interm\u00e9diation locative, o\u00f9 elle atteint 65 % des revenus locatifs.<\/p>\n\n\n\n<p>Il faut savoir qu&rsquo;il y a m\u00eame une prime de 1000 \u20ac pour les propri\u00e9taires qui louent en Loc2 ou Loc3 avec interm\u00e9diation locative (2000 \u20ac si c&rsquo;est avec mandat de gestion), major\u00e9e de 1000 \u20ac si le bien a une surface inf\u00e9rieure ou \u00e9gale \u00e0 40 m\u00b2.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Des aides sp\u00e9cifiques pour r\u00e9aliser des travaux<\/h2>\n\n\n\n<p>Avec Loc\u2019Avantages, en plus de la r\u00e9duction fiscale, les propri\u00e9taires peuvent b\u00e9n\u00e9ficier d\u2019<strong>aides financi\u00e8res pour r\u00e9aliser des travaux de r\u00e9novation<\/strong> dans le logement mis en location :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>jusqu\u2019\u00e0 28 000 \u20ac d\u2019aides pour une r\u00e9novation lourde ;<\/li>\n\n\n\n<li>jusqu\u2019\u00e0 15 000 \u20ac d\u2019aides pour une r\u00e9novation \u00e9nerg\u00e9tique.<\/li>\n<\/ul>\n\n\n\n<p>Il est \u00e9galement possible de b\u00e9n\u00e9ficier, sous certaines conditions, de l\u2019accompagnement d\u2019un sp\u00e9cialiste pour r\u00e9aliser les travaux (notamment pendant toutes les d\u00e9marches administratives) et d\u2019acc\u00e9der \u00e0 un \u00e9copr\u00eat \u00e0 taux z\u00e9ro ou au pr\u00eat avance r\u00e9novation pour financer le solde de la facture restant \u00e0 la charge du propri\u00e9taire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Attention aux dates limites de d\u00e9p\u00f4t des dossiers<\/h2>\n\n\n\n<p>La plateforme de l\u2019Anah a ouvert 1er avril 2022, mais tout bail ayant pris effet depuis le 1er janvier 2022 peut \u00eatre \u00e9ligible \u00e0 Loc Avantages. La r\u00e9duction d\u2019imp\u00f4t est valable \u00e0 partir de la date de prise d\u2019effet du bail, m\u00eame si le d\u00e9p\u00f4t de la demande de convention \u00e0 l\u2019Anah est r\u00e9alis\u00e9 post\u00e9rieurement.
