{"id":789,"date":"2024-12-30T14:51:58","date_gmt":"2024-12-30T13:51:58","guid":{"rendered":"https:\/\/www.locservice.fr\/guides\/?p=789"},"modified":"2025-07-02T16:26:06","modified_gmt":"2025-07-02T14:26:06","slug":"loi-scellier","status":"publish","type":"post","link":"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/loi-scellier","title":{"rendered":"Loi Scellier"},"content":{"rendered":"\n<p class=\"a-retenir wp-block-paragraph\">Le dispositif <strong>Scellier <\/strong>est l&rsquo;anc\u00eatre du Duflot, devenu le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/loi-pinel\">Pinel<\/a>. <strong>Disparu fin 2012<\/strong>, il avait pour but d&rsquo;encourager l&rsquo;investissement locatif dans le neuf gr\u00e2ce \u00e0 une d\u00e9fiscalisation allant jusqu&rsquo;\u00e0 25 % du prix d&rsquo;acquisition, en \u00e9change d&rsquo;un engagement de louer pendant au moins 9 ans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La <strong>loi Scellier<\/strong>, du nom du d\u00e9put\u00e9 \u00e0 l&rsquo;origine de cette loi, a \u00e9t\u00e9 approuv\u00e9 <strong>d\u00e9but 2009<\/strong> et a <strong>pris fin le 31 d\u00e9cembre 2012<\/strong>. Ce dispositif d&rsquo;investissement locatif vient en compl\u00e9ment des r\u00e9gimes existants comme le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/borloo-neuf\">Borloo<\/a> et le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/investissement-locatif\/robien-recentre\">Robien<\/a>.<br>Le dispositif Scellier a pour objectif de favoriser les constructions gr\u00e2ce aux investissements locatifs.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter\"><a href=\"https:\/\/www.locservice.fr\/proprietaires\/\"><img decoding=\"async\" src=\"https:\/\/locservicev2.s3.eu-west-3.amazonaws.com\/guide\/cta-ls-prop.jpg\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">L&rsquo;avantage fiscal de la loi Scellier<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Afin d&rsquo;attirer un grand nombre d&rsquo;investisseurs, le <strong>dispositif Scellier<\/strong> propose un avantage fiscal important : une r\u00e9duction d&rsquo;imp\u00f4t \u00e9gale \u00e0 un pourcentage du prix d&rsquo;acquisition du bien (25 %, dans la limite de 300.000 \u20ac et limit\u00e9e \u00e0 un bien par an, pour 2009 et 2010).<br>En 2011, le taux est pass\u00e9 \u00e0 22 % pour les logements labellis\u00e9s BBC (B\u00e2timent Basse Consommation) et \u00e0 13 % pour les autres logements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><u>Attention<\/u><\/strong> : pour 2012, le taux est de 13 % et ne concerne que les logements BBC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En 2012, la r\u00e9duction d&rsquo;imp\u00f4t est soumise \u00e0 un second plafond : le prix au m\u00e8tre carr\u00e9 qui varie selon les zones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A noter : pour un bien acquis en 2010, le taux applicable tout au long des 9 ann\u00e9es est le taux de r\u00e9duction en cours lors de l\u2019acquisition, soit 25 %. C\u2019est un taux \u00ab acquis \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ce syst\u00e8me Scellier est \u00e9galement applicable (dans certains cas tr\u00e8s limit\u00e9s) aux logements anciens r\u00e9nov\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les obligations de la loi Scellier<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Comme pour le Robien, l&rsquo;engagement de location est de 9 ans minimum. Au-del\u00e0 des 9 ans de location, l&rsquo;investisseur a la possibilit\u00e9 d&rsquo;avoir un compl\u00e9ment de 2% par an entre la dixi\u00e8me et la quinzi\u00e8me ann\u00e9e de location. La r\u00e9duction d&rsquo;imp\u00f4t est plafonn\u00e9e par d\u00e9cret selon les zones g\u00e9ographiques, afin de favoriser les secteurs o\u00f9 le d\u00e9calage entre l&rsquo;offre et la demande de logements est plus important.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les plafonds de prix d&rsquo;achat en \u20ac \/ m<sup>2<\/sup><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Zones<\/th><th>Plafond (\u20ac\/m<sup>2<\/sup>)<\/th><\/tr><\/thead><tbody><tr><td>Zone A bis et A<\/td><td>5 000<\/td><\/tr><tr><td>Zone B<\/td><td>4 000<\/td><\/tr><tr><td>Zone B2<\/td><td>2 100<\/td><\/tr><tr><td>Zone C<\/td><td>2 000<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Exemple d&rsquo;investissement avec le dispositif Scellier<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Concr\u00e8tement, si vous achetez un logement neuf d&rsquo;une valeur de 150.000 \u20ac, vous pourrez d\u00e9duire de vos imp\u00f4ts 25% de ce montant sur 9 ans (37.000 \u20ac), \u00e0 raison de 7.500 \u20ac la premi\u00e8re ann\u00e9e et 3.750 \u20ac les 8 ann\u00e9es suivantes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En 2012 si vous achetez un bien neuf de 60 m\u00b2 \u00e0 150.000 \u20ac (soit 2.500 \u20ac\/m<sup>2<\/sup>) situ\u00e9 en zone B2, vous respectez bien le 1er plafond de 300.000 \u20ac.
