{"id":815,"date":"2024-12-23T15:21:44","date_gmt":"2024-12-23T14:21:44","guid":{"rendered":"https:\/\/www.locservice.fr\/guides\/?p=815"},"modified":"2025-11-25T15:21:38","modified_gmt":"2025-11-25T14:21:38","slug":"diagnostics-copropriete","status":"publish","type":"post","link":"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/copropriete\/diagnostics-copropriete","title":{"rendered":"Les diagnostics en copropri\u00e9t\u00e9"},"content":{"rendered":"\n<p class=\"a-retenir\">Pour la s\u00e9curit\u00e9 de l&rsquo;habitat, la loi impose aux <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/copropriete\/syndic-copropriete\">syndicats des copropri\u00e9taires<\/a> de faire r\u00e9aliser des diagnostics techniques dans les parties communes des copropri\u00e9t\u00e9s : <strong>le DTA (Dossier Technique Amiante), le CREP (Constat des Risques d&rsquo;Exposition au Plomb), le Diagnostic Termites.<\/strong> En cas de vente d&rsquo;un appartement, le vendeur doit joindre le dossier des <strong>diagnostics techniques des parties communes de la copropri\u00e9t\u00e9<\/strong> au contrat de vente. Il est important de noter qu&rsquo;un copropri\u00e9taire bailleur n&rsquo;a pas besoin de fournir les diagnostics des parties communes \u00e0 son locataire mais seulement les <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/diagnostics-location\">diagnostics du logement<\/a>.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Le Diagnostic Amiante<\/h2>\n\n\n\n<p>Le <strong>Dossier Technique Amiante<\/strong> doit \u00eatre effectu\u00e9 dans tout immeuble dont le permis de construire a \u00e9t\u00e9 d\u00e9livr\u00e9 avant le 01\/07\/1997 et doit \u00eatre tenu \u00e0 la disposition des occupants.<\/p>\n\n\n\n<p>Ce diagnostic a une validit\u00e9 illimit\u00e9e s&rsquo;il confirme l&rsquo;absence d&rsquo;amiante. S&rsquo;il \u00e9tablit la pr\u00e9sence d&rsquo;amiante, un nouveau contr\u00f4le doit \u00eatre effectu\u00e9 tous les 3 ans sauf si le diagnostiqueur expert estime qu&rsquo;il y a trop d&rsquo;amiante et que des travaux doivent imp\u00e9rativement \u00eatre effectu\u00e9s. Si l&rsquo;expert pr\u00e9conise d&rsquo;effectuer des travaux, il y a vote en assembl\u00e9e, mais si les travaux ne sont pas effectu\u00e9s, la responsabilit\u00e9 civile et p\u00e9nale du syndicat des copropri\u00e9taires peut \u00eatre engag\u00e9e.<\/p>\n\n\n\n<p>Ce diagnostic est obligatoire depuis 2005 et doit par ailleurs \u00eatre n\u00e9cessairement tenu \u00e0 la disposition de tout acheteur potentiel d&rsquo;un lot de la copropri\u00e9t\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le Constat de Risque d&rsquo;Exposition au Plomb (CREP)<\/h2>\n\n\n\n<p>Concerne tout immeuble <strong>construit avant le 1er janvier 1949<\/strong>.<\/p>\n\n\n\n<p>Si le premier <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/diagnostic-plomb\">constat de risque d&rsquo;exposition au plomb<\/a> est n\u00e9gatif (absence de plomb), il devient valable pendant 30 ans. Par contre, si le constat d\u00e9voile un risque, l&rsquo;expert diagnostiqueur avertira la pr\u00e9fecture et la copropri\u00e9t\u00e9 sera oblig\u00e9e d&rsquo;effectuer les travaux n\u00e9cessaires pour supprimer tout risque. Si les travaux ne sont pas effectu\u00e9s, la responsabilit\u00e9 civile et p\u00e9nale du syndicat des copropri\u00e9taires (lien vers : Qu&rsquo;est-ce qu&rsquo;une copropri\u00e9t\u00e9 ? Un syndicat des copropri\u00e9taires) peut \u00eatre engag\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le Diagnostic Termites<\/h2>\n\n\n\n<p>Le <strong>Diagnostic Termites<\/strong> concerne les immeubles en copropri\u00e9t\u00e9 situ\u00e9s des les zones couvertes par un plan de pr\u00e9vention des risques. Il est <strong>valable 6 mois<\/strong>. Si le diagnostic \u00e9tablit la pr\u00e9sence de termites, il faut obligatoirement le signaler en mairie.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le Diagnostic de Performance Energ\u00e9tique (DPE) collectif<\/h2>\n\n\n\n<p>Le Diagnostic de Performance Energ\u00e9tique Collectif permet d&rsquo;\u00e9tablir la quantit\u00e9 d&rsquo;\u00e9nergie consomm\u00e9e ou estim\u00e9e pour une utilisation standardis\u00e9e du b\u00e2timent. Chauffage, eau chaude sanitaire, refroidissement. Il peut comporter des recommandations d&rsquo;ordre g\u00e9n\u00e9ral pour l&rsquo;am\u00e9lioration \u00e9nerg\u00e9tique.<\/p>\n\n\n\n<p>Il ne faut donc pas le confondre avec un diagnostic thermique, qui consiste en un examen plus pouss\u00e9 et qui permet non seulement de calculer la performance \u00e9nerg\u00e9tique mais aussi de proposer des solutions qui permettraient de r\u00e9duire la consommation \u00e9nerg\u00e9tique. Le diagnostic thermique liste donc diff\u00e9rentes actions envisageables ; ce qui n&rsquo;est pas le cas du <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/dpe-location\">diagnostic de performance \u00e9nerg\u00e9tique<\/a> qui est un simple constat.<\/p>\n\n\n\n<p>Depuis la loi Climat et R\u00e9silience, le DPE collectif est <strong>obligatoire <\/strong>pour les copropri\u00e9t\u00e9s dont le permis de construire a \u00e9t\u00e9 d\u00e9livr\u00e9 <strong>avant le 1\u1d49\u02b3 janvier 2013<\/strong>. Ce diagnostic permet d\u2019\u00e9valuer la performance \u00e9nerg\u00e9tique globale de l\u2019immeuble et d\u2019identifier les travaux n\u00e9cessaires pour r\u00e9duire sa consommation \u00e9nerg\u00e9tique.<\/p>\n\n\n\n<p>Le calendrier des obligations est progressif :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Depuis le <strong>1\u1d49\u02b3 janvier 2024<\/strong> : copropri\u00e9t\u00e9s de plus de 200 lots.<\/li>\n\n\n\n<li>\u00c0 partir du <strong>1\u1d49\u02b3 janvier 2025<\/strong> : copropri\u00e9t\u00e9s comportant entre 50 et 200 lots.<\/li>\n\n\n\n<li>\u00c0 partir du <strong>1\u1d49\u02b3 janvier 2026<\/strong> : copropri\u00e9t\u00e9s de 50 lots ou moins.<\/li>\n\n\n\n<li>\u00c0 partir du <strong>1\u1d49\u02b3 janvier 2028<\/strong> : application en Guadeloupe, Guyane, Martinique, La R\u00e9union et Mayotte.<\/li>\n<\/ul>\n\n\n\n<p>La validit\u00e9 d\u2019un DPE collectif est de <strong>10 ans<\/strong>. <\/p>\n\n\n\n<p>\u261d\ufe0f A noter : un rapport d&rsquo;inspection de la chaudi\u00e8re doit \u00e9galement \u00eatre \u00e9tabli par le diagnostiqueur qui effectue le DPE si le b\u00e2timent est \u00e9quip\u00e9 d&rsquo;une chaudi\u00e8re collective d&rsquo;une puissance sup\u00e9rieure \u00e0 20kW.<\/p>\n\n\n\n<p class=\"has-border-color has-background\" style=\"border-color:#30a2ce;border-width:1px;background-color:#d2e8ef\">\u2139\ufe0f Gr\u00e2ce \u00e0 notre partenaire, b\u00e9n\u00e9ficiez de <strong>5 % de r\u00e9duction<\/strong> sur votre prestation de diagnostic immobilier ! <strong><a href=\"https:\/\/bailleur.locservice.fr\/diagnostics-immobiliers\">Cliquez ici<\/a><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cas particulier de la mise en copropri\u00e9t\u00e9 d&rsquo;un immeuble<\/h2>\n\n\n\n<p>Si un immeuble construit depuis plus de 15 ans est mis en copropri\u00e9t\u00e9, il faut r\u00e9aliser un<strong> diagnostic technique pr\u00e9alable \u00e0 la mise en copropri\u00e9t\u00e9<\/strong>.
