{"id":952,"date":"2024-12-24T10:57:49","date_gmt":"2024-12-24T09:57:49","guid":{"rendered":"https:\/\/www.locservice.fr\/guides\/?p=952"},"modified":"2025-11-24T16:37:59","modified_gmt":"2025-11-24T15:37:59","slug":"loyer-colocation","status":"publish","type":"post","link":"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/loyer-colocation","title":{"rendered":"Le loyer de la colocation"},"content":{"rendered":"\n<p class=\"a-retenir\">Dans le cas d&rsquo;un bail collectif, le loyer est r\u00e9parti entre tous les colocataires, \u00e9quitablement ou proportionnellement \u00e0 la surface privative de chacun. Ce loyer peut \u00eatre r\u00e9vis\u00e9 annuellement si une clause le pr\u00e9voit dans le bail.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<p>Depuis l\u2019entr\u00e9e en vigueur de la <strong>loi ALUR<\/strong>, dans le cas d\u2019un logement lou\u00e9 en <strong>colocation<\/strong> dans une zone soumise \u00e0 l&rsquo;<a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/encadrement-loyers-alur\">encadrement des loyers<\/a>, la somme des loyers acquitt\u00e9s par chaque colocataire ne peut pas \u00eatre sup\u00e9rieure au montant du loyer qui serait demand\u00e9 \u00e0 un locataire unique (m\u00eame dans le cas d&rsquo;une colocation \u00e0 baux multiples). Ce qui revient \u00e0 dire que dans ces zones tendues, il n\u2019est plus possible de louer en colocation pour louer plus cher qu\u2019en location.<\/p>\n\n\n\n<p>Dans les autres zones, les <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/colocation-quotidien\/drois-devoirs-colocation\">droits des propri\u00e9taires bailleurs<\/a> permettent toujours fixer librement le montant du loyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Comment est fix\u00e9e la quote-part de loyer de chaque colocataire ?<\/h2>\n\n\n\n<p><strong>S\u2019il y a un <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/bail-colocation#bail-collectif\">bail unique<\/a><\/strong> sur lequel ne figure que le montant global du loyer, ce montant est divis\u00e9 entre tous les colocataires. Soit \u00e0 parts \u00e9gales, soit en tenant compte de la taille des chambres et en appliquant alors une r\u00e8gle proportionnelle.<\/p>\n\n\n\n<p>En cas de bail unique, on parle souvent de <strong>\u00ab cl\u00e9 de r\u00e9partition \u00bb<\/strong>. Il s\u2019agit en fait d\u2019un tableau listant tous les colocataires, leur part de loyer leur part de charges et leur part du d\u00e9p\u00f4t de garantie.<\/p>\n\n\n\n<p><strong>Si chaque colocataire est titulaire d\u2019un bail<\/strong>, le montant du loyer d\u00fb par chaque colocataire figure sur son bail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La r\u00e9vision du loyer dans une colocation<\/h2>\n\n\n\n<p>Comme pour la location traditionnelle, le loyer hors charges d\u2019une colocation peut \u00eatre <strong>r\u00e9vis\u00e9<\/strong> en cours de bail ou lors de son renouvellement.<\/p>\n\n\n\n<p>La r\u00e9vision du loyer en cours de bail n\u2019est possible que si une clause de r\u00e9vision figure dans le bail.<\/p>\n\n\n\n<p>La r\u00e9vision annuelle du loyer a lieu \u00e0 la date fix\u00e9e dans le bail, <a href=\"https:\/\/www.locservice.fr\/guides\/guide-proprietaire\/mettre-son-logement-location\/irl-loyer\">selon l\u2019indice de r\u00e9vision des loyers<\/a>. En l\u2019absence de date, elle a lieu \u00e0 la date d\u2019anniversaire du bail.<\/p>\n\n\n\n<p>Avant l\u2019entr\u00e9e en vigueur de la loi ALUR, un propri\u00e9taire qui oubliait de r\u00e9viser annuellement le loyer disposait d\u2019un d\u00e9lai de r\u00e9troactivit\u00e9 de 5 ans. Il pouvait donc demander un rattrapage pour les 5 derni\u00e8res ann\u00e9es. D\u00e9sormais, <strong>le d\u00e9lai de prescription est de 1 an<\/strong>.<\/p>\n\n\n\n<p>La <strong>r\u00e9vision du loyer<\/strong> lors du renouvellement du bail n\u2019est possible que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>si le loyer appliqu\u00e9 est manifestement sous-\u00e9valu\u00e9 par rapport au march\u00e9 et donc aux prix des loyers pratiqu\u00e9s dans le voisinage pour un logement de m\u00eames caract\u00e9ristiques<\/li>\n\n\n\n<li>si le propri\u00e9taire informe les colocataires du nouveau loyer, par lettre recommand\u00e9e, au moins 6 mois avant la fin du bail.<\/li>\n<\/ul>\n\n\n\n<p>Les colocataires peuvent accepter, refuser ou ignorer la proposition d\u2019augmentation. Faute d\u2019accord entre toutes les parties au bail, elles peuvent saisir l\u2019une comme l\u2019autre la commission d\u00e9partementale de conciliation qui cherchera \u00e0 trouver un accord.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quelles sont les charges dans une colocation ?<\/h2>\n\n\n\n<p>Les colocataires doivent r\u00e9gler leur <strong>quote-part de loyer et de charges<\/strong> pour <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/colocation-quotidien\/repartition-financiere-colocation\">bien g\u00e9rer les finances dans la colocation<\/a>.
