{"id":957,"date":"2024-12-24T11:00:03","date_gmt":"2024-12-24T10:00:03","guid":{"rendered":"https:\/\/www.locservice.fr\/guides\/?p=957"},"modified":"2025-11-24T17:28:43","modified_gmt":"2025-11-24T16:28:43","slug":"bail-colocation","status":"publish","type":"post","link":"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/bail-colocation","title":{"rendered":"Le bail de la colocation"},"content":{"rendered":"\n<p class=\"a-retenir\">Il existe deux types de contrats de colocation : le bail individuel avec lequel chaque colocataire a son propre bail, et le bail collectif o\u00f9 tous les colocataires sont sur le m\u00eame bail. Ce dernier est g\u00e9n\u00e9ralement accompagn\u00e9 d&rsquo;une clause de solidarit\u00e9 qui lie les colocataires pour le paiement du loyer.<\/p>\n\n\n\n<div id=\"div-gpt-ad-1534773938396-0\" style=\"text-align: center;\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Est-ce qu\u2019un propri\u00e9taire peut refuser de louer en colocation ?<\/h2>\n\n\n\n<p>Un propri\u00e9taire bailleur a tout \u00e0 fait <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/colocation-quotidien\/drois-devoirs-colocation\">le droit<\/a> de <strong>refuser de louer son bien en colocation<\/strong>.<\/p>\n\n\n\n<p>Par contre, s\u2019il accepte cette forme de location, il a ensuite le droit d\u2019exiger la signature d\u2019une <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/clause-solidarite\">clause de solidarit\u00e9<\/a>, une caution solidaire pour chacun des colocataires. Il peut \u00e9galement <strong>refuser un colocataire<\/strong> propos\u00e9 en remplacement d\u2019un colocataire sortant et il peut choisir le rempla\u00e7ant. Attention toutefois dans ce cas de ne pas introduire dans la colocation existante un \u00e9l\u00e9ment perturbateur car cela pourrait se retourner contre le bailleur si une mauvaise ambiance apparaissait dans la colocation suite \u00e0 l\u2019arriv\u00e9e d\u2019un colocataire choisi par le bailleur mais non coopt\u00e9 par les occupants.<\/p>\n\n\n\n<p>Lors d\u2019un changement de colocataire, le propri\u00e9taire a le droit d\u2019<strong>exiger la signature d\u2019un nouveau bail<\/strong> au lieu de proc\u00e9der par avenant. Et s\u2019il y a un bail unique pour tous les colocataires, il ne peut pas <strong>imposer un nouveau colocataire<\/strong> sans l\u2019accord de tous les autres colocataires. Ces derniers doivent en effet signer l\u2019avenant au bail \u00e9tabli suite au changement de locataire, et s\u2019ils ne sont pas d\u2019accord avec le choix du propri\u00e9taire, ils peuvent refuser de signer l\u2019avenant d\u2019entr\u00e9e du nouveau colocataire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"bail-individuel\">Bail individuel<\/h2>\n\n\n\n<p>Depuis l\u2019entr\u00e9e en vigueur de la <strong>loi Alur<\/strong> le 27 mars 2014, un propri\u00e9taire bailleur qui loue son bien en colocation peut faire signer un bail unique commun \u00e0 tous les colocataires ou faire signer \u00e0 chaque colocataire un bail individuel.<\/p>\n\n\n\n<p>Dans le cadre d\u2019un <strong>bail individuel<\/strong> par colocataire, il n\u2019y a pas de solidarit\u00e9 du paiement du loyer et des charges, et cette forme de bail qui n\u2019est pas avantageuse pour les bailleurs n\u2019est pas tr\u00e8s courante.<\/p>\n\n\n\n<p>En signant un bail individuel, le propri\u00e9taire accorde \u00e0 chacun des colocataires un droit de jouissance exclusive de certaines pi\u00e8ces du logement (la chambre) mais aussi un droit d\u2019acc\u00e8s commun \u00e0 tous pour d\u2019autres pi\u00e8ces (cuisine, salle de bain, pi\u00e8ce \u00e0 vivre\u2026).<\/p>\n\n\n\n<p>Le logement est donc divis\u00e9 en autant de parties distinctes qu\u2019il y a de baux, et chaque partie doit r\u00e9pondre aux normes de d\u00e9cence et de surface minimum.<\/p>\n\n\n\n<p>Il est plus facile de mettre fin \u00e0 un bail individuel en colocation qu\u2019\u00e0 un bail collectif car le colocataire qui souhaite partir n\u2019a qu\u2019\u00e0 donner son cong\u00e9 par lettre recommand\u00e9e avec avis de r\u00e9ception en respectant les conditions et pr\u00e9avis. Le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/resiliation-colocation\/depart-colocataire\">colocataire sortant<\/a> n\u2019est pas tenu de chercher un rempla\u00e7ant m\u00eame s\u2019il peut avoir int\u00e9r\u00eat \u00e0 le faire s\u2019il souhaite par exemple r\u00e9duire la dur\u00e9e de son pr\u00e9avis et donc sa quote-part de loyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"bail-collectif\">Bail collectif ou bail \u00e0 preneurs multiples ou bail unique<\/h2>\n\n\n\n<p>Le <strong>bail collectif <\/strong>ou <strong>bail \u00e0 preneurs multiples<\/strong> ou <strong>bail unique<\/strong> est la forme la plus courante de bail pour une colocation. Cette forme de contrat de location lie tous les colocataires entre eux et au bailleur. Le bail unique accorde \u00e0 tous les signataires les m\u00eames droits et obligations et ils <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/colocation-quotidien\/parties-privees-communes\">se r\u00e9partissent \u00e0 leur guise les pi\u00e8ces du logement<\/a> (alors qu\u2019elles sont attribu\u00e9es dans le cadre de baux individuels).<\/p>\n\n\n\n<p>Le bail unique inclut g\u00e9n\u00e9ralement une clause de solidarit\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bail de colocation : des mentions obligatoires et des mentions facultatives<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Mentions obligatoires :<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le nom ou la d\u00e9nomination du bailleur.<\/li>\n\n\n\n<li>L\u2019adresse du bailleur ou son si\u00e8ge social ou ceux de son mandataire.<\/li>\n\n\n\n<li>L\u2019identit\u00e9 du ou des colocataires.<\/li>\n\n\n\n<li>La dur\u00e9e du bail ainsi que sa date de prise d\u2019effet. Les conditions de son renouvellement et de sa r\u00e9siliation.<\/li>\n\n\n\n<li>La destination du logement (usage d\u2019habitation ou usage professionnel ou les deux).<\/li>\n\n\n\n<li>La description des locaux et de leurs \u00e9quipements.<\/li>\n\n\n\n<li>Le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/loyer-colocation\">montant du loyer<\/a> et des <a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/colocation-quotidien\/repartition-financiere-colocation\">charges de la colocation<\/a>.<\/li>\n\n\n\n<li>Le montant de la garantie (<a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/garant-colocation\">caution<\/a>) si elle est pr\u00e9vue.<\/li>\n\n\n\n<li>L\u2019<a href=\"https:\/\/www.locservice.fr\/guides\/guide-colocataire\/debut-colocation\/etat-lieux-colocation\">\u00e9tat des lieux<\/a> (doit \u00eatre joint en annexe au bail).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Mentions facultatives :<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le <a href=\"https:\/\/www.locservice.fr\/guides\/guide-locataire\/entree-logement\/depot-garantie\">d\u00e9p\u00f4t de garantie<\/a>, s\u2019il est pr\u00e9vu.<\/li>\n\n\n\n<li>L\u2019indexation des loyers si elle est pr\u00e9vue.<\/li>\n\n\n\n<li>Pour un bail collectif, la clause de solidarit\u00e9 si elle est pr\u00e9vue.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"clause-resolutoire\">Clause r\u00e9solutoire<\/h2>\n\n\n\n<p>Une clause r\u00e9solutoire est habituellement pr\u00e9vue dans le bail. Elle recense les cas dans lesquels le bail peut s\u2019arr\u00eater de plein droit.<\/p>\n\n\n\n<p>Les cas les plus fr\u00e9quemment pr\u00e9vus dans cette clause sont :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le d\u00e9faut d\u2019ex\u00e9cution d\u2019une de leurs obligations par les colocataires :\n<ul class=\"wp-block-list\">\n<li>D\u00e9faut de paiement du loyer ou des charges.<\/li>\n\n\n\n<li>D\u00e9faut d\u2019ex\u00e9cution des obligations d\u2019entretien et de jouissance paisible des lieux.<\/li>\n\n\n\n<li>D\u00e9faut d\u2019entretien des meubles (si bail en meubl\u00e9) et des \u00e9quipements mis \u00e0 disposition des colocataires.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>La violation d\u2019une obligation l\u00e9gale ou r\u00e9glementaire.<\/li>\n<\/ul>\n<div
